ORDER:

Heard Sri D. Sudarshan Reddy, learned counsel appearing on behalf of the petitioner, learned Government Pleader for Endowments, appearing on behalf of respondent Nos.1 to 3 and Sri J. R. Manohar Rao, learned Standing Counsel appearing on behalf of respondent No.4. 2. The petitioner approached the Court seeking prayer as under:

“…to issue appropriate writ, order or direction, more particularly, a Writ of Mandamus, declaring the Impugned Proceedings in Memo No.G3/9035/2023, dt.15.07.2023, of the 2nd Respondent Commissioner, Endowments, Hyderabad, in constitution of Non-Hereditary Trust Board, appointing the respondents No.5-10 herein as Members of the Trust board, to the 4th respondent subject Sri Lakshmi Venkateswara Swamy Temple, Road No.1 and 12, Banjara Hills, Hyderabad, and the consequential Orders of the 3rd respondent herein in Rc.No.B3/2967/2022,dt.15.07.2023, for administration of Oath of Office and Secrecy, are as illegal, arbitrary, unjust without following and in violating the provisions of the Endowments Act, and the Rules, by exercising the colourful Jurisdiction, consequently to set-aside as illegal, arbitrary and contrary to the law, in violation of the provisions of the Endowments Act,1987 and pass such other order and further orders in the interest of Justice and in the circumstances of the case.”

Learned counsel appearing on behalf of the petitioner and learned Government Pleader for Endowments, appearing on behalf of the respondent Nos.1 to 3 submit that the cause of action in the present writ petition does not survive for adjudication, anymore and the writ petition has become infructuous.

4. Bringing the said submission made by both the learned counsel on record, the writ petition is dismissed as infructuous.

However, there shall be no order as to costs.

5. The interim order granted by this Court on 21.07.2023 stands vacated.

Miscellaneous petitions, if any, pending in this Writ Petition, shall stand closed.
