Heard Sri Umashankar Nemmikanti, learned

counsel appearing on behalf of the petitioners, learned Assistant Government Pleader for Agriculture appearing on behalf of the respondent Nos.1, 2, 4, 5 and 7 and the learned Assistant Government Pleader for Revenue appearing on behalf of the respondent

Nos.3 and 6.

2. The petitioner approached the Court seeking

prayer as under:

“…to pass an order or a writ or a direction, most specifically one in the nature of a writ of Mandamus

declaring the action of the respondents in stopping the Rythu Bandhu to the petitioners and consequently direct the respondents to release the Rythu Bandhu to

the petitioners and pass.…”

3. The case of the petitioners in brief as per the averments made in the affidavit filed by the petitioners in support of the present Writ Petition is

as under:-

i) The petitioners are the owner and possessor of agricultural land and were receiving benefits under Rythu Bandhu Scheme without interruption. A third party had filed O.S.No.158 of 2024 on the file of Hon’ble Additional Junior Civil Judge at Devarakonda and the Hon’ble Additional Junior Civil Judge at Devarakonda had granted interim injunction only for restraining alienation of property, but not

for cultivation.

ii) The petitioners were suddenly denied Rythu Bandhu benefits and thereafter, the petitioners had approached the Agriculture Department but the Authorities failed to release the Rythu Bandhu amounts. Aggrieved by the same, the petitioners approached this Court by filing the present writ

petition.

DI SCUSSI ON AND CONCLUSI ON:

4. Learned counsel appearing on behalf of the petitioners submits that the subject issue in the present Writ Petition issquarely covered by the order of this Court dated 25.06.2025 passed in W.P.No.17704 of 2025 and hence, petitioners herein are entitled for grant of the same relief as extended to

the petitioners in W.P.No.17704 of 2025

5. Learned Assistant Government Pleader for Agriculture appearing on behalf of the respondent Nos.1, 2, 4, 5 and 7 and the learned Assistant Government Pleader for Revenue appearing on behalf of the respondent Nos.3 and 6 do not dispute the said submission made by the learned counsel appearing on

behalf of the petitioners.

6. TAKI NG I NTO CONSI DERATI ON:

a) The aforesaid facts and circumstances of

the case,

b) The submissions made by the learned

counsel appearing on behalf of the petitioners and the

learned Assistant Government Pleader for Agriculture appearing on behalf of the respondent Nos. 1, 2, 4, 5 and 7 and learned Assistant Government Pleader for Revenue appearing on behalf of respondent Nos.3 and

6,

c) The discussion and conclusion as arrived at

paragraph Nos.4 and 5 of the present order,

The w rit petition is disposed of, directing the

petitioners to make an application to the respondent- Authorities for release of Rythu Bandhu amount w ithin a period of tw o (02) w eeks from the date of receipt of a copy of this order. I n the event, such an application is made by the petitioners, and if the same fulfils all the requirements for sanction of the amounts as per petitioners’ legal entitlement, the respondents shall consider the representation of the petitioners for release of the Rythu Bandhu amounts, uninfluenced by the ad-interim injunction order passed in O.S.No.158 of 2024 on the file of learned Additional Junior Civil Judge at Devarakonda. I n any event, if the application of the petitioners does not fulfil the requirements for sanction of Rythu Bandhu
