Heard Sri B.Mayur Reddy, learned Senior Counsel representing Sri Sanjay Kumar Agarwal, learned counsel for the appellants, Sri T.Surya Sathish, learned counsel representing Sri V.Seetharama Avadhani, learned counsel for respondent No.1 and Sri Shashi Kiran Pasunuri, learned Standing Counsel for TSLSA.

2. This Appeal is preferred under Section 96 of the Civil Procedure Code challenging the order dated 05.03.2026, in I.A.No.1792 of 2025 in O.S.No.l32 of 2025, passed by the learned VI Additional District Judge, Ranga Reddy District at Kukatpally.

3. This Appeal has little background. Respondent No.1 has filed an application under Section 21 of the Legal Services Authorities Act, 1987 vide PLC.No.70 of 2012 before the Chairman, Mandal Legal Services Committee, Cyberabad, Kukatpally, against respondent Nos.3, 4, 5 and husband and father of the appellants herein i.e., Sri M.Ganga Raju.

4. On 30.03.2013, Lok Adalat held at Kukatpally had passed an award recording that ‘respondents therein have agreed to execute registered sale deeds within two months from the said date and the respondent No.1 herein has agreed to pay balance sale consideration of Rs.15,00,000/- and also agreed to bear the stamp duty and registration charges for the sale deeds to be executed by respondents therein. Respondents therein have agreed that if they failed to execute the sale deeds within stipulated period of two months, respondent No.1 herein can directly file the Execution Petition before the concerned Court. This award is binding only on the parties to the said case’.

5. Thereafter, respondent No.1 herein has filed an Execution Petition vide E.P.No.262 of 2022, on the file of the learned VI Additional District Judge, Ranga Reddy District at Kukatpally. The said E.P. is pending. The husband and father of the appellants [M.Ganga Raju] died in the year 2014.

Appellants herein have filed a Writ Petition vide W.P.No.27193 of 2023, challenging the proceedings in E.P.No.262 of 2022 in PLC.No.70 of 2012, dated 30.03.2013, passed by the Charman, Mandal Legal Service Committee, Cyberabad, Kukatpally at Miyapur. Vide order dated 29.10.2024, the Division Bench of this Court allowed the said Writ Petition in part granting leave to the appellants herein to avail civil jurisdiction to challenge the impugned award dated 30.03.2013, passed in PLC.No.70 of 2012 within a month from the date of receipt of a copy of the order and if the suit is filed, the proceedings in E.P.No.262 of 2022 in the above PLC is kept in abeyance, till the disposal of the said suit.

7. Thereafter, appellants herein have filed a suit in O.S.No.132 of 2025 before the learned VI Additional District and Sessions Judge – cum – Family Court, Ranga Reddy District at Kukatpally against respondent Nos.1 and 2 seeking declaration to declare the award in PLC.No.70 of 2012 dated 30.03.2013 on the file of the respondent No.2 as null and void and not binding on the plaintiffs.
