ORDER

Alleging willful and deliberate disobedience of the orders of this Court dated 25.09.2025 in W.P.No.28188 of 2025, this Contempt Case is filed.

2. The unofficial respondent No.4 in the contempt case and respondent No.6 in the writ petition has filed a counter affidavit along with a copy of building permission granted to him on 15.09.2025. It is submitted that the 4th respondent is making construction strictly in accordance with the building permission and in view of the contempt case filed and in view of the status quo order passed by this Court, the respondent officials are obstructing his construction.

In view of the above facts and circumstances, this Court finds that even before the order was passed by this Court on 25.09.2025 at the admission stage, respondent No.6 therein and respondent No.4 in the contempt case has already been granted building permission and the appeal filed by respondent No.4 was against the earlier rejection of the representation of the petitioner and the same was also withdrawn by respondent No.4 on 07.10.2025.

In view thereof, this Court is inclined to close the contempt case and also make it clear that since respondent No.4 has already been granted building permission, the order of status-quo shall not be continued. However, liberty is granted to the writ petitioner to challenge the building permission, if he so chooses.

5. Accordingly, the Contempt Case is closed. There shall be no order as to costs. Miscellaneous petitions, if any, shall stand closed.
