ORDER:

This writ petition is filed with the following prayer:

“… to issue a writ or order or direction more particularly one in the nature of Writ of Mandamus; to declare the action of respondent Nos.2, 4, 5 and 6 in not supplying paddy for custom milling to the petitioner on par with other rice millers for the Rabi Marketing Season 2026-07, is as illegal, arbitrary and violative of the orders dated 04.09.2025 passed by this Hon’ble Court in W.P.No.26821 of 2025 apart from being violative of Articles 14, 19(1)(g) and 21 of the Constitution of India; consequently, direct the respondent Nos.2, 4, 5 and 6 to supply CMR paddy for custom milling by entering into Custom Milling Agreement with the petitioner for the Rabi Marketing Season 2026-07 on par with other rice millers without reference to Crime No.128 of 2025 on the file of Kalur Timmandoddi Police Station and; to pass such other order or orders as this Hon’ble Court may deem fit just and proper in the circumstances of the case.”

2. Heard Mr. R.S. Sumith Raj, learned counsel for petitioner, learned Assistant Government Pleader for Civil Supplies appearing for respondent Nos.1, 2 and 5, Ms. Dara Haritha Kiran, learned Government Pleader for Revenue appearing for respondent Nos.3 and 4 and Mr. K. Devender, learned Standing Counsel for Civil Supplies appearing fro respondent Nos.6 and 7.

As learned counsels agreed for disposal of the writ petition at the admission stage, the matter is being heard and disposed of.

3. Case of petitioner is that petitioner is a proprietary concern engaged in the business of rice milling and allied activities at the milling unit at Nandinne Village, Kaloor Timmandoddi Mandal, Jogulamba Gadwal District.

Petitioner claims that he is carrying on rice milling operations since 2012 by entering into Custom Milling Agreement(s) with the Telangana State Civil Supplies Corporation. Petitioner was issued show cause notices dated 19.07.2025 (P10), 18.08.2025 (P12), and 22.08.2025 (P14).

It is further submitted that petitioner filed W.P.No.35072 of 2025 seeking exclusion of the period from 28.08.2025 to 22.10.2025 from the Custom Milling Agreements and thereby extending the agreement period and delivery timelines by 55 days. Pursuant to the interim orders passed in W.P.No.35072 of 2025, petitioner has been receiving custom milled rice from the authorities.

Learned counsel invited the attention of this Court to W.P.No.35123 of 2025 and submitted that the action of respondent Nos.2, 4 5 and 6 therein in not supplying paddy for custom milling to petitioner on par with other rice millers for Kharif Marketing Season 2025-26 as illegal and violative of the order dated 04.09.2025 passed by this Court in W.P.No.26821 of 2025. It is further submitted that a learned Single Judge of this Court, by order dated 21.11.2025, disposed of W.P.No.35123 of 2025 and directed respondent No.4 (Collector (CS)) that without reference to the pending Crime No.128 of 2025, if the issues pertain to only shortfall, the Commissioner to take a decision expeditiously, preferably within a period of two (2) weeks and thereafter pass orders for supply of CMR paddy to petitioner for Kharif Season of 2025-26, but, the said order is not implemented till date. Hence, learned counsel for petitioner sought indulgence of this Hon’ble Court to direct the respondent authorities that petitioner be made eligible for supply of paddy for supply of custom milling of rice for the Rabi Marketing Season 2026-27 by entering into a Custom Milling Agreement, without reference to Crime No. 128 of 2025 on the file of Kaloor Timmandoddi Mandal Police Station. Hence, the writ petition.

6. On the other hand, learned Assistant Government Pleader for Civil Supplies submitted that the Rabi Marketing Season for 2026-27 has not yet commenced and that the writ petition is premature.
