ORDER:

This writ petition is filed questioning the inaction of respondent No.3 in not disposing the petitioner’s representation / complaint dated 15.04.2026. A consequential prayer is sought to direct respondent Nos.1 to 3 to demolish the illegal construction consisting of Stilt + 4 floors in premises bearing plot No.78 West Part, Hanuman Nagar, Survey No.60/E New (Old No.60 Part), Karmanghat Village, L.B.Nagar, Circle-4, L.B.Nagar Zone, Saroornagar Mandal, GHMC, Rangareddy District and to direct respondent No.3 to dispose of petitioner’s representation / complaint dated 15.04.2026.

2. The facts giving rise to filing of this writ petition are as follows:

The petitioner claims to be the resident of Plot No.18, Hanuman Nagar, Meerpet, near TKR College, Balapur, Rangareddy District. It is submitted that the respondent No.4 claims to be the owner of the subject property. It is further submitted that though the permission was sanctioned to respondent No.4 for construction of residential building consisting of stilt for parking + 2 upper floors, the respondent No.4 has illegally converted stilt portion into mulgies and constructed additional floors without maintaining mandatory setbacks and beyond the permission limits Aggrieved by the action of respondent No.4, the petitioner made a representation to respondent No.3 on 15.04.2026 requesting to take appropriate action against such illegal construction activity. But the respondent No.3 has not acted upon the petitioner’s representation till date. As such, the present writ petition is filed.

3. Heard learned counsel for the petitioner and learned counsel representing Mr. Srinivasa Rao Pachwa, learned Standing Counsel for GHMC appearing for respondent Nos.2 and 3 and perused the material made available on the record.

4. Learned counsel for the petitioner submits that since petitioner’s representation dated 15.04.2026 is still pending for consideration, the respondent authorities may be directed to consider the same and take action in a time bound period.

On the other hand, learned counsel appearing for the respondent Nos.2 and 3 would submit that the petitioner’s representation dated 15.04.2026 will be considered, if not already considered, and appropriate action would be initiated, in accordance with law, and prays this Court to pass appropriate orders.

Since this Court, time and again, directed the Municipal Authorities to initiate action against the illegal constructions by following due process of law, it is noticed that the authorities are failing to initiate action against the illegal constructions. However, in some of the cases, authorities are issuing statutory notices and thereafter not proceeding further to initiate further course of action unless writ petitions are filed for not considering complaints/

representations made to civic authorities.

It is not out of place to mention Section 7(6) of the Telangana State Building Permission Approval and Self Certification System (TG- bPASS) Act, 2020 (for short ‘the TG-bPASS Act’) encourages citizens to put on notice to the Civic Authorities regarding unauthorized constructions. Section 7(6) of the TG-bPASS Act is extracted for reference.

“7. Approval of Building Permissions-

(6) Citizens shall be encouraged to bring to the notice of Municipality and District Collector cases where unauthorized construction or construction in violation of or in excess of permissions, in the manner prescribed.
