This Transfer Criminal Petition is filed seeking to transfer
S.C.No.197 of 2020 from the file of Court of the Special Sessions Judge for the Trial of SCs/STs (POA) Act cases-cum-II- Additional Sessions Judge at Nalgonda to the Special Court for Trial of the Cases under SCs/STs (POA) Act of Ranga Reddy
District at L.B.Nagar.
2. Heard Sri N.Ananda Rao, learned counsel appearing for the petitioners and Sri M.Ramachandra Reddy, learned Additional Public Prosecutor appearing for respondent-State.

None appeared on behalf of the 2nd respondent-defacto
complainant.

The learned counsel for the petitioners contends that the counsel representing the petitioners before the trial Court had lodged a complaint against the Presiding Officer, which has allegedly resulted in bias and prejudice against them. It is therefore submitted that, if the matter is proceeded with before the same Presiding Officer, there is a reasonable apprehension of injustice being caused to the petitioners. Hence, it is prayed that this Court may be pleased to transfer the case to any other
competent Court at Ranga Reddy District, L.B. Nagar.

The learned Additional Public Prosecutor, opposed the said submissions and contended that the allegation of bias against the Presiding Officer is wholly baseless and unsupported by any material on record. It is contended that merely because a complaint is alleged to have been made against the Presiding Officer, the same cannot, by itself, be a ground to presume prejudice or likelihood of injustice. There is no substantive evidence to demonstrate that the Presiding Officer has acted in a biased manner or that the petitioners would not receive a fair trial. Hence, prayed to dismiss this
transfer petition.

Considering the submissions made by both the parties except making allegations against the Presiding Officer, no other material is placed before this Court to transfer the case from the Special Sessions Judge for the Trial of SCs/STs (POA) Act cases- cum-II-Additional Sessions Judge at Nalgonda to Special Court for Trial of the Cases under SCs/STs (POA) Act of Ranga Reddy District at L.B.Nagar and it is mere apprehension of petitioners that they may not get justice in the said Court. Mere apprehension is not a ground to transfer the case from one Court to other Court and parties cannot make allegations against the Presiding Officer without any basis. Further, all the witnesses are from Nalgonda, and they should not be made to suffer despite there being no fault on their part. Hence, there are no valid reasons to transfer the case from the said Court, as
such this transfer criminal petition is liable to be dismissed.
6. Accordingly, this Transfer Criminal Petition is dismissed.
Miscellaneous petitions, if any, pending in this revision
shall stand closed.
