ORDER

This Criminal Petition has been filed seeking to quash the proceedings in F.I.R. No.173 of 2026 on the file of Balapur Police Station, Hyderabad District, wherein the petitioner was arrayed as accused for the offences punishable under Section 318(4) of the Bharatiya Nyaya Sanhita, 2023 and Section 7 of Essential Commodities Act.

2. Heard Mr. K. Venumadhav, learned counsel for the petitioner and Mr.V.Jithendar Rao, learned Additional Public Prosecutor for respondent No.1.

3. The specific allegation against the petitioner/accused is that he has procured PDS wheat from the beneficiaries at cheaper rate to sell the same for profit and on 06.04.2026 the petitioner was found in possession of 168 plastic bags and 21 sealed gunny bags of PDS wheat totaling 69.30 quintals.
