ORDER
In this writ petition, the petitioner is seeking a declaration that the action of the respondents in not issuing appointment orders to the petitioners alone against the ST vacancy of S.G.T., Kannada Medium of the erstwhile Medak District, for which the petitioner was selected, while issuing appointment orders to the other eight candidates selected along with the petitioner, as illegal and arbitrary and consequently, to hold that the petitioner is entitled to be appointed as SGT Kannada Medium ST vacancy and to pass such other order or orders in the interest of justice.
2. Brief facts leading to the filing of the present writ petition are that the petitioner is a local candidate of Medak District and belongs to ST Community. It is stated that pursuant to the Notification No.53/2017, dated 21.10.2017, issued by the respondent No.3, the petitioner has applied for the post of Secondary Grade Teacher (SGT), Kannada Medium and participated in the written test conducted on 02.03.2018 with Hall Ticket No.1753500033. It is stated that respondent No.3 has published the ranking list of TRT-2017 for the Secondary Grade Teacher posts of Kannada Medium and the petitioner has secured 39.47 marks out of 100 and stood at 37th State rank in Medak District. It is stated that the counseling and verification of certificates was conducted on 14.08.2018 and a provisional list of selected candidates was issued by TSPSC on 01.03.2019, selecting 14 members for a total number of 25 vacancies notified. It is stated that the petitioner’s Hall Ticket number was also included in the selected list of candidates. A list of 9 candidates who were provisionally selected was also sent to the erstwhile Medak District, in which the petitioner’s name was at Serial No.9, but eight candidates, who are included in the said list, were given appointment orders and only the petitioner was not given the appointment order. It is stated that in the counseling, the petitioner has given the option selection as P.S.Yesgi Village, but the petitioner was not given the appointment order and his case was kept pending and therefore, the petitioner submitted representations to the Chairman and Secretary of TSPSC on 29.08.2018, but no orders have been received on the said representation. Challenging the inaction on the part of the respondents in issuing the appointment order to the petitioner, the present writ petition has been filed.

Learned counsel for the petitioner has drawn the attention of this Court to the Notification No.53/2017, dated 21.10.2017, issued by the respondents and also the selection list wherein the name of the petitioner was shown at Serial No.9. He has drawn the attention of this Court to the educational certificates of the petitioner to demonstrate that he is qualified and eligible for the post of Secondary Grade Teacher, Kannada Medium. He has drawn the attention of this Court to the educational qualifications required for Secondary Grade Teacher that i.e., he must possess Intermediate/Senior Secondary (or its equivalent) as recognized by the Board of Intermediate, Telangana with atleast 50% marks (in case of SC/ST/BC/Differently abled candidates, the minimum marks shall be 45%) and pass in Two year Diploma in Elementary Education/ Four year Bachelor in Elementary Education.
