ORDER
Heard Sri Bobbala Jyothirmai, learned counsel
appearing on behalf of the petitioner and the learned Assistant Government Pleader for Stamps and Registration appearing on behalf of the respondent
Nos.1 and 2.
2. The petitioner approached the Court seeking
prayer as under:

“…to issue Writ or direction preferably Writ of Mandamus, declaring the action of the Respondent No.2, in not receiving, registering and releasing the Gift Deed presented in respect of Residential House bearing Municipal No. 43-133, comprising of Ground and First Floors with RCC total built-up area 2850 Sft. having land area and admeasuring 192 Sq. Yrds. or 160.51 Sq. Mtrs., in Sy. No. 384/1, situated at Hanuman Nagar, Moula-ali, under G.H.M.C. Circle No. 4 (erstwhile Circle No. 17), Malkajgiri Mandal, Medchal- Malkajgiri District (erstwhile Rangareddy District), is illegal, arbitrary and contrary to provisions of law and violation of Article 300-A of the Constitution of India, and consequently direct the Respondent No.2 to receive, process, register and release Gift Deed / any other deeds that may be presented by the Petitioner in respect of Residential House bearing Municipal No. 43- 133, comprising of Ground and First Floors with RCC total built-up area 2850 Sft. having land area and admeasuring 192 Sq. Yrds. or 160.51 Sq. Mtrs., in Sy. No. 384/1, situated at Hanuman Nagar, Moula-ali, under G.H.M.C. Circle No. 4 (erstwhile Circle No. 17), Malkajgiri Mandal, Medchal-Malkajgiri District (erstwhile Rangareddy District), without insisting No- objection Certificate (NOC) from the Respondent No.3 and pass such other or further orders as this Hon’ble Court may deem fit and proper in the circumstances of
the case.…”
3. The case of the petitioner in brief as per the averments made in the affidavit filed by the petitioner
in support of the present Writ Petition is as under:-
i) The petitioner is the absolute owner and possessor of a residential house bearing Municipal No. 43-133 situated at Hanuman Nagar, Moula-ali, Medchal-Malkajgiri District, which the petitioner inherited from her deceased husband

and subsequently obtained full rights through a registered Release Deed executed by her children in petitioner’s
favour.
ii) While the petitioner intended to gift the said property to the petitioner’s grandson and approached the Sub- Registrar for registration of the Gift Deed, the Respondent No.2 refused to receive and register the document on the ground that the survey number allegedly belongs to Respondent No.3. Aggrieved by the same, the petitioner
approached this Court by filing the present writ petition.
DI SCUSSI ON AND CONCLUSI ON:
4. Learned counsel appearing on behalf of the petitioner submits that the issue involved in the present w rit petition is squarely covered by the order of this Court dated 27.03.2025 passed in W.P.No.9269 of 2025, and hence, the petitioner in the present w rit petition is also entitled for grant of the similar relief as extended to the petitioner in W.P.No.9269 of 2025.

5. Learned Assistant Government Pleader for Stamps and Registration appearing on behalf of the respondents does not dispute the said submission made by the learned counsel appearing on behalf of
the petitioner.
