This Writ Petition is filed under Article 226 of Constitution of India seeking the following relief/s:-
“…to issue an Appropriate Writ Order or Direction in the nature of a Writ of Mandamus under Article 226 of the Constitution declaring the Impugned Award No.Nil/2017-18, File No.A11817/2017-IXPatta, dated 03.01.2019 passed under Act, 30 of 2013 and all other consequential proceedings are in violation of Section 17(3-A), 17(5)(a)(b), r/w Section 5- A of Act 1 of 1894 and as the same is also barred by limitation as per Section 11-A of Act, 1 of 1894 is illegal, arbitrary and voilation of the principles of natural justice, procedures and provisions of Land Acquisition Act, 1894 Act 30 of 2013 and set aside/Quash the Award No. Nil/2017-18, File No.A1/1817/2017I-XPatta, dated 03.01.2019 passed under Act, 30 of 2013 including the consequential proceedings if any which is passed by the Respondent No.2 and 3 in so far as the Petitioner’s land in Sy.No.778 to an extent of Ac. 1-06 ½ gts., situated at Cheerlavancha Village, Thangallapally Mandal, Rajanna Sircilla District and consequently direct the Respondents herein to initiate fresh acquisition proceedings and pass Award by paying compensation to the petitioner under The Right to Fair Compensation and Transparency in Land Acquisition Rehabilitation and Resettlement Act, 2013 in respect of the Petitioner’s land in Sy.No.778 to an extent of Ac 106 ½ gts., situated at Cheerlavancha Village, Thangallapally Mandal, Rajanna Sircilla District and pass Prayer amended as per C O dt 27 02 2026 in IA No
1/2025…”
2. Heard Sri B.Arjun Rao, learned counsel for the petitioner and Ms.Katta Radha Reddy, learned Assistant Government Pleader for Land Acquisition, appearing for respondents.
3. The present Writ Petition was initially filed challenging the action of the respondents seeking to dispossess the petitioner without paying the compensation in respect of the schedule land. Consequently, the petitioner also sought a direction for payment of compensation.
4. During the pendency of the writ petition, impugned award dated 03.01.2019, was passed by respondent No.4 without conducting any enquiry. Thereafter, the petitioner filed an application vide I.A. No. 1 of 2025 seeking amendment of the prayer, to challenge the said award in respect of the subject land consisting of the land in Survey No.778 to an extent of Ac.1-06½ Gts., situated at Cheerlavancha Village, Thangallapally Mandal, Rajanna Sircilla District and also to seek fresh acquisition proceedings thereby paying compensation to the petitoner under Section 30 of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013.

When the matter is taken up for final hearing, learned counsel for the petitioner has drawn the attention of this Court to the impugned award dated 03.01.2019 passed by respondent No.4 dated 03.01.2019, wherein, the name of the petitioner reflects at serial No.5 in respect of the subject land shown as Category ‘A’. The total compensation determined is Rs.10,36,869/- based on Market Value Revision-2013 pertaining to Cheerlavancha village dated 15.10.2007 under the Land Acquisition Act, 1894.

It is specific contention of the petitioner that since the award is passed after coming into force of the Act, 2013, the respondents are bound to determine the compensation based on the prevailing market value as on the relevant date under the new Act. The proceedings are deemed to have lapsed in terms of Section 24(1)(a) of the Act, 2013 as no valid award was passed by respondent No.4 prior to its commencement.
