This Court passed the following:-

ORDER:

Heard Sri Rama Mohan Palanki, learned counsel for the Applicants and Sri CSN Raju, learned counsel for the respondent.

2. The present Arbitration Application is filed under Section 11 (5) and (6) of the Arbitration and Conciliation Act, 1996 (hereinafter ‘the Act, 1996’) for appointment of Arbitrator to adjudicate the disputes between the parties.

3. Both, the applicants and the respondent have entered into a registered Lease Deed bearing document No.8323 of 2021 dated 23.04.2021 with regard to letting out the following subject property on specific terms and conditions mentioned therein:-

“Building on Plot No.16, admeasuring 503 yards in survey Nos.31 to 36, Block No.1, situated at Madhapur Village, Serilingampally Mandal, Ranga Reddy District, Telangana State – 500081”.

Clause 7 of the said agreement deals with the dispute resolution, it is relevant and extracted below:-

“7. In case of any dispute or difference arising out of or in relation to this Lease Deed, then the same shall be resolved and settled with the provision of the Arbitration and Conciliation Act, 1996 or any statutory modification or re-enactments thereof. The place of arbitration shall be in Hyderabad”.

4. According to the applicants, there are disputes between them and the respondent with regard to the execution of the said Lease Deed dated 23.04.2021 and letting out the said property. Therefore, the applicants had issued a legal notice dated 23.04.2025 to the respondent proposing the name of Sri R.L.Shankar, a Retired District Judge, as an arbitrator as per Clause No.7 of the agreement dated 23.04.2021 to resolve the disputes.

5. The respondent issued reply notice dated 23.06.2026 proposing the name of Sri T.V.K. Murthy, Advocate, as a sole arbitrator to settle the disputes. As the applicant is not agreeable to the said proposal, he has filed the present application.

6. The aforesaid facts would reveal that there are disputes between the applicants and the respondent with regard to the terms of the Registered Lease Deed dated 23.04.2021 and letting out the subject property. The same are arbitrable in nature.

7. In the light of the aforesaid discussion, the present Arbitration Application is allowed. Accordingly,

Consequently, miscellaneous Petitions, pending if any, in this Arbitration Application, shall stand closed.
