ORDER:

The petitioners are aggrieved by the impugned Sealing Notice No.50/W33/UC/C-12/MMC/2026, dated 02.04.2026, issued by respondent Nos.2 and 3 in respect of (i) property bearing House No.11-7-237/NR, situated on Plot No.39, Northern part, admeasuring 200 square yards (equivalent to 167.23 square meters), in H.I.G. category in Survey No.9/1 at Saroornagar Residential Complex, Saroornagar Village, Ranga Reddy District, belonging to Petitioner No.1, and (ii) property bearing House Nos.11-7-237 and 11-7-237/1, situated on Plot No.39, Southern part, admeasuring 200 square yards (equivalent to 167.23 square meters), in Survey No.9/1 at the same locality, belonging to Petitioner No.2, whereby the respondents have sealed the entire building of the petitioners without considering the building permissions granted vide File No.010390/GHMC/03321/IABP/C5/2025, dated 29.07.2025, for construction of Ground + 2 upper floors. The petitioners seeks a consequential prayer to set aside the impugned Sealing Order vide No.50/W33/UC/C-12/MMC/2026, dated 02.04.2026.

The brief facts of the case as stated are that the petitioner No.1 claims to be the owner and possessor of the house bearing No.11-7-237/NR, situated on Plot No.39, Northern part, admeasuring 200 square yards (equivalent to 167.23 square meters), in H.I.G. category in Survey No.9/1 at Saroornagar Residential Complex, Saroornagar Village, Ranga Reddy District, having purchased the same under a registered sale deed bearing Document No.3919/2025, dated 23.06.2025. Petitioner No.2 claims to be the owner and possessor of the house bearing Nos.11-7-237 and 11-7-237/1, situated on Plot No.39, Southern part, admeasuring 200 square yards (equivalent to 167.23 square meters), in Survey No.9/1 at the same locality, having purchased the same under a registered sale deed bearing Document No.3920/2025, dated 23.06.2025 (hereinafter referred to as “the subject property”). The petitioners, with an intention to construct residential buildings on their respective plots, applied for building permission to respondent Nos.2 and 3 and obtained separate building permissions vide File Nos.010390/GHMC/03321/IABP/C5/2025 and 010392/GHMC/03322/IABP/C5/2025, dated 29.07.2025, permitting construction of stilt + 2 upper floors individually. It is further submitted that petitioner No.2 and her husband are doctors and intend to establish a charitable hospital in the said premises. Since both the plots are adjacent and contiguous, forming a single compact plot owned by the petitioners, who are father and daughter, the petitioners intend to develop the property jointly.

It is submitted that after completing construction up to stilt + 2 upper floors, the petitioners applied for revised building permission for Ground + 4 upper floors before respondent No.3 on 30.01.2026 by submitting revised plans and paid the requisite fees. Thereafter, the respondent authorities have not passed any orders on the said application. It is further submitted that the petitioners constructed the slabs up to two upper floors strictly in accordance with the permissions granted on 29.07.2025. The petitioners were of the opinion that they would be granted revised permission for construction up to Ground + Four upper floors, considering that the combined extent of the property admeasures 400 square yards. The respondent Nos.2 and 3 issued the impugned notice bearing No.50/W33/UC/C-12/MMC/2026, dated 02.04.2026, under Section 461-A of the GHMC Act, 1955, sealing the structure on the ground stating that the construction was carried out up to stilt + 4 upper floo
