With the consent of both parties, this Writ Petition is

taken up for disposal at the stage of admission.

2. Heard Sri Rohit Pigula, learned counsel for the

petitioners, learned Assistant Government Pleader for Revenue

appearing for respondent Nos.1 and 2, learned Standing

Counsel for Municipality appearing for respondent No.3 and

learned Assistant Government Pleader for MAUD appearing for

respondent No.4.

3. Learned counsel for the petitioners submits that the

petitioners, being the real owners, pattedars and possessors of

the land admeasuring Acs.31-36 guntas in Sy.No.136/A,

137/A1, 137/A2, 137/AA & 136/A, situated at Indresham

village, Patancheru Mandal, Sangareddy District, intend to

develop the said lands by converting it into house site plots.

Accordingly, the petitioners have applied to the Tahsildar,

Patancheru Mandal, Sanga Reddy District, for conversion of

lands from agriculture to non-agriculture purposes vide

proceedings No.2102073791, 21010738823, 20101073761 &

2101073803, dated 15.12.2021, and NALA orders were issued

in favour of the petitioners. Subsequently, the petitioners

decided to give the lands on development to petitioner No.5 and

entered into multiple registered Development Agreements cum

General Power of Attorney bearing Doc.No.2136/2022,

2137/2022, 2138/2022, 2139/2022 dated 30.07.2022 and

23481/2022 dated 28.06.2022, in respect of land admeasuring

1,36,125’ square yards.

4. Learned counsel for the petitioners further submitted that

petitioners have access to their land through a 60 feet wide

road located on the north-eastern side, which is the only

access. Prior to obtaining layout permission from HMDA

authority for layout, petitioner No.5 sought No Objection from

the Gram Panchayat Office. Thereafter, petitioner No.5 applied

to HMDA for layout approval vide application

No.059832/SKP/LT/U6/HMDA/28022023 dated 28.02.2023,

and draft layout approval was granted upon satisfaction of

prima facie title and possession. Further petitioner No.5 also

mortgaged 15.49% of plotted area in favour of HMDA vide

Doc.No.1023/2023 dated 15.07.2023 and paid necessary fees

to Executive authority, Indresham Gram Panchayat.

Consequently, layout permission was released vide proceedings

No.GP/03/2023 dated 13.09.2023. The petitioners thereafter

commenced development works. Later, the petitioners came to

know that out of the 60 feet road, only 20 feet is private land

owned by the mother of petitioner No.1 vide registered sale deed

bearing document No.3461 of 1994 dated 13.10.1994, and the

remaining 40 feet forms part of Government land (Kareezkhata)

in Ac.0-16 guntas in Sy.No.138/1. Accordingly, petitioner No.5

had submitted a representation dated 27.02.2026 to the Chief

Commissioner of Land Administration, Revenue Department,

Hyderabad for allotment of the government land. The CCLA,

vide letter, dated 09.04.2026, requested the District Collector,

to consider the application submitted by the petitioner for

alienation/allotment of Ac.0-16 guntas in terms of

G.O.Ms.No.571 dated 14.09.2022. However, no action has been

taken by the District Collector. Therefore, the petitioners seek

indulgence of this Court to direct the concerned respondent

authorities to consider their request and alienate Ac.0-16

guntas on payment of market value within a stipulated period

of time.

5. Learned Assistant Government Pleader appearing for the

respondents fairly submits that since the representation is

being pending with the District collector, vide Reference

No.Assn.I/3670066/2026 dated 09.04.2026, the District

collector will take appropriate action on the letter addressed by

the CCLA in accordance with law.
