ORDER:

This writ petition is filed seeking the following relief:

“…to issue an order or direction more particularly one in the nature of Writ of MANDAMUS declaring the action of the 5th Respondent in not allotting the shop to the petitioner in the 4th respondent Agriculture Market Committee Gudimalkapur by considering the representation of the petitioner dated 24.07.2023 and 05.12.2022 as the same allotment is pending for a period of last (13) years as arbitrary, illegal and in violation of Articles 14 and 21 of the Constitution of India and consequently direct the respondents to allot service provider shop in the 4th respondent Agriculture Market Committee, Gudimalkapur wherein there are seven (7) vacant shops are existing in the 4th respondent Agriculture Market Committee Gudimalkapur pending the disposal of the above writ petition and to pass….”

2. Heard Ms. T.Jyothi Devi, learned counsel for petitioner and learned Government Pleader for Agriculture for respondent Nos.1 to 3 & 5.

3. It is observed from the writ petition docket that Mr. N.Uma Shankar, learned Standing Counsel for Agricultural Marketing Committee bearing enrolment No.26698, has attested the signature, and the writ petition was filed on 13.10.2025.

4. Learned counsel for respondent No.4-Agricultural Market Committee, is not present before this Court though the matter is listed and notice has been duly served.

It is the case of the petitioner that he has been making repeated requests to respondent-authorities for last 13 years and has been running around the offices for allotment of a service provider shop at Gudimalkapur Flower Market. It is stated that respondent-authorities allotted shops only to seven members, excluding the petitioner. It is further stated that an open auction was conducted on 13.06.2017 for (115) slots for service providers in accordance with G.O.Ms.No.261, dated 24.10.2009, and only 65 members participated in open auction. That out of 65 participants, 62 members quoted the upset price for open spaces and have constructed shed.

6. Petitioner is engaged in the business of selling garlands, submissions are made regarding allotment pattern and location of service providers within the market. This Court is not inclined to go into these aspects. It is the specific case of petitioner that no shop is allotted to petitioner, his representations, dated 05.12.2022 and 24.07.2023, are pending for consideration. Learned counsel invited the attention of this Court to G.O.Ms.No.261, shifting of flower market from Jambagh to Gudimalkar, and GO.Ms.No.6, dated 12.01.2011, which deals with allotment of shops in available space.

7. Ex.P3 is the representation received in the office of Agricultural Market Committee Gudimalkapur, an office stamp is present. Ex.P4, page No.20, is the notice, dated 11.02.2023.

8. Heard learned counsels, perused the record and considered the submissions.

Petitioner’s case is that he is entitled to be allotted a shop as a service provider in Gudimalkapur Flower Market Yard, and that he made a representation dated 05.12.2022 (Ex.P3-page 18), pursuant to which no allotment was made. In the notice, dated 11.02.2023 (issued by the Secretary, Agricultural Market Committee, Gudimalkapur), it is seen that the authority stated that the Agricultural Market Committee would allot space in the flower market without violating the judgment of this Court dated 28.09.2011 in W.P.No.27075 of 2011. It is also reflected from the said letter that the petitioner was requested to submit Aadhar cards and photos within seven days from the date of receipt of the notice.

Learned counsel submitted across the bar that the conditions intimated to the petitioner i.e., Aadhar cards and two photos were submitted within time i.e., seven days from the date of receipt of notice.
