IN THE HIGH COURT FOR THE STATE OF TELANGANA AT HYDERABAD

THE HONOURABLE SRI JUSTICE N.TUKARAMJI

WRIT PETITION No.24194 of 2019

01st May, 2026

Between:

S.R.M.Venkata Lakshmi Narsimha Dev.

…Petitioner

AND

The State of Telangana and others.

…Respondents

ORDER:

This Writ Petition is filed with the following relief:

“…pleased to issue a writ, order or direction n particularly one in the nature of writ of mandamus declaring the action of the 4th respondent calling the petitioner to police station as illegal, arbitrary and consequent direct the 4th respondent not to call the petitioner to police station with regard petitioner complaint dated 15-10-2019 and to pass............”

Heard Mr.Md.Chand Pasha, learned counsel representing Mr.R.R.Kalyan, learned counsel for the petitioner and Mr.D.Pradeep, learned Assistant Government Pleader for Home.

Learned counsel for the petitioner submits that he is appearing only as a proxy counsel, has no instructions in the matter, and seeks appropriate directions from this Court.

Learned Assistant Government Pleader for Home submits that the presence of the petitioner was required on the relevant date in connection with the investigation/enquiry in Crime No. 93 of 2019. He further contends that the allegation that the petitioner is being repeatedly called to the police station and made to wait throughout the day is incorrect and baseless. It is also submitted that the police are acting strictly within the bounds of law, and therefore, the petition is liable to be dismissed.

I have perused the material available on record.

The grievance of the petitioner is that the respondent police are summoning him to the police station without any tenable reason, and he seeks appropriate direction to respondent No. 4.

Having regard to the explanation offered by the respondents through the learned Assistant Government Pleader, this Court is of the view that securing the presence of the petitioner for the purpose of enquiry/investigation in connection with a crime is reasonable. However, summoning the petitioner and making him wait throughout the day is not proper. Accordingly, this Court finds it appropriate to issue necessary directions to respondent No. 2.

Accordingly, the respondent police authorities are directed not to call the petitioner to the police station except on lawful grounds, and only by issuing a written summons specifying the time, purpose, and nature of the enquiry. Further, the respondent police shall not interfere with the life and liberty of the petitioner, except in strict accordance with law and by following due process.

With this direction, this writ petition is disposed of. There shall be no orders as to costs.

Miscellaneous Petitions, pending if any, shall stand closed.
