ORDER:

The present Writ Petition is filed under Article 226 of Constitution of India for the following relief/s:-

‘‘… to pass an order or direction more particularly one in the nature of writ of mandamus or any other appropriate writ or direction holding that the continuation of the proceedings under Section 145 Cr.P.C. issued by Respondent No.4 in Proc.No. C/443/2022 dated 01-04-2022, in respect of the entire land measuring Ac.00-37 gts., including the property of the Petitioner measuring Ac.00-08¾ gts. in Sy.No.287 of Uthkur Village, Luxettipet Mandal, Mancherial District, is illegal, arbitrary, politically motivated, malicious, against the provisions of Section 145 Cr.P.C., against the principals of natural justice and fair play, besides violative of Articles 14, 19, 21 & 300A of the Constitution of India and may be pleased to direct the Respondents No.2 to 6 to close the proceedings in Proc.No. C/443/2022 dated 01-04-2022 by considering the Reply/Claim dated 07-04-2022 filed by the Petitioner and to pass such other order or orders …”

2. Heard Mr.MD.Ajmal Ahmed, learned counsel for the petitioner, Mr.M.Srinivas, learned Assistant Government Pleader for Home appearing for respondent Nos.1, 5 and 6 and Mr.K.Mahesh, learned Assistant Government Pleader for Revenue appearing for respondent Nos.2 to 4. Perused the record.

Learned Assistant Government Pleader for Revenue by filing the copy of proceedings issued by respondent No.4 vide Rc.No.B/535/2026 dated 02.05.2026 under Section 164 of Bharatiya Nagarik Suraksha Sanhitha, 2023 submits that the impugned proceedings vide Rc.No.C/443/2022 dated 01.04.2022 are dropped by directing the parties to seek remedies before the competent civil Court. Therefore, he submits that the cause in this Writ Petition does not survive for adjudication and seeks to dismiss the Writ Petition as infructuous.

4. Learned counsel for the petitioner and learned Assistant Government Pleader for Home concede to the said request.

5. Recording the submissions of all the learned counsel, this Writ Petition is dismissed as infructuous. No costs. It is made clear, this order shall not preclude the official respondents to initiate appropriate action in accordance with law, if situation so warrants. Since, notice is directed upon respondent No.7 further service of notice on respondent No.7 stands dispensed with.

Miscellaneous Petitions, pending if any, shall stand closed.
