ORDER : ( ORAL )

This writ petition is filed by the petitioners aggrieved by the action of the respondents’ authorities in including their lands in Survey No.777 of Mucherla Village, Hasanparthy Mandal, Hanumakonda District, in the prohibitory list, as per Section 22-A(1)(a) of the Registration Act 1908 (for short ‘Registration act’) in the Bhu Bharati Portal in spite of their representations dated 03.09.2025 and 12.03.2026 made in compliance with the order of this Court in W.P. No.14905 of 2025 dated 18.06.2025, without affording an opportunity of hearing to them as illegal, improper, arbitrary, in violation of principles of natural justice and Articles 21 and 300-A of the Constitution of India.

2.1. It is submitted that the petitioners are lawful owners and possessors of the total land admeasuring Acs.9-24 guntas in Survey No.777 and its sub-division numbers i.e., petitioner No.1 holds the land admeasuring Acs.2-20 guntas in Survey Nos.777/18, 777/41, 777/31 to 33, 777/36 to 38 and 777/40; petitioner No.2 holds Acs.2-00 of the land in Survey No.777/18, 777/41, 777/32 to 34, 777/36 to 38 and 777/40; petitioner No.3 holds Acs.4-00 of land in survey Nos.777/2 to 15, 777/17 and 777/19; and petitioner No.4 holds Ac.1-00 in Survey Nos.777/20 to 23; situated at Mucherla Village, Hasanparthy Mandal, Hanumakonda District.

2.2. It is submitted that the subject lands are patta lands and are not assigned lands. As per Khasra Pahani 1954-55, the entire land admeasuring Acs.11-00 guntas in Survey No.777 was classified as “Bhancharai’ and such lands are ineligible for assignment by the Government as per G.O. Ms. No.1406, Revenue, dated 25.07.1958. The land was subsequently divided into 44 sub-divisions after 1971-72, distributed to the occupant families, and from 1973-74, the revenue authorities collected land revenue from each family individually thereby officially recognizing their occupancy rights. The concerned authorities issued patta certificates to the allottees under G.O. Ms. No.1406 read with G.O. Ms. No.1724, Revenue, dated 26.08.1959.

2.3. When Sri Ram Sagar Project (SRSP) was constructed and a small portion of Ac.1-16 guntas was acquired for canal purposes (DBM 24 embankment), the Land Acquisition Officer conducted a formal award enquiry and recognized ownership rights of 28 pattadars and paid compensation to them. Thereafter, the revenue authorities officially recorded in the Nakal Sethwar that Ac.1-16 guntas is canal land (kaluva) and the remaining Acs.9-24 guntas is pata land with ‘Dar’ and Assessment particulars which conclusively proves that the subject lands claimed by the petitioners are patta lands.

3. Heard Mr. K.V. Rajendra Prasad, learned counsel for the petitioners; Mr. L. Ravinder, learned Assistant Government Pleader for Revenue; and perused the material on record.

4.1. Mr. K.V. Rajendra Prasad, learned counsel for the petitioners, submitted that the respondents authorities without conducting any enquiry have erroneously included the subject lands in the prohibitory list in the Bhu Bharati Portal without issuing any prior notice to the petitioners. The Bhu Bharati Portal reflects an extent of Acs.11-00 guntas in Survey No.777 as prohibited land contrary to the Nakal Sethwar which discloses only an extent of Ac.1-16 guntas as canal land and the remaining Acs.9-24 guntas as patta land. The Tahsildar, Hasanparthy, by his report vide Rc. No.B/1356/2023 dated 10.07.2023 to respondent No.3 - the District Collector, Hanumakonda District, stated that the petitioners have purchased the subject lands under the registered documents and were issued pattadar pass books and title deeds.

4.2. Aggrieved by the illegal action of the respondents, the petitioners filed W.P. No.14905 of 2025 which was disposed of by this Court by the order dated 18.06.2025 directing the petitioners to file an application under Section 22-A(4) of the Registration Act 1908 seeking de-notification of
