Heard learned counsel for the petitioner and Sri G.Madhusudan Reddy, learned Standing Counsel appearing for respondent Nos.2 and 3. With the consent of the parties, the writ petition is being taken up for disposal at the admission stage itself.

2. This writ petition has been filed seeking the following prayer:-

“to issue a Writ more particularly in the nature of Mandamus declaring the action of the Respondents No.2 and 3 in not taking action against the Unauthorized Construction done by the Respondent No.4 as illegal, arbitrary and violative of provisions of the GHMC Act and consequently direct the Respondents No. 2 and 3 to forthwith demolish the unauthorized and illegal construction done by the Respondent No.4 at door no. 10-3-PLOT-82, East Marredpally Mettuguda Circle and Pass such other orders as this Hon'ble Court may deem fit and proper in the facts and circumstances of the case...”

The case of the petitioner, in brief, is that the petitioner is a social activist and resident of West Marredpally, Secunderabad, and is aggrieved by the inaction of the respondent Nos.2 and 3 in not taking action on the complaints dated 07.04.2026, 15.04.2026 and 20.04.2026 by which, it was brought to their notice regarding the unauthorized and illegal construction being undertaken by respondent No.4 at premises bearing Door No.10-3- PLOT-82, East Marredpally, Mettuguda Circle, Hyderabad. It is the specific case of the petitioner that respondent No.4 is carrying on construction activity without obtaining any valid permission from the GHMC authorities and in gross violation of the Building Rules and provisions of the GHMC Act. It is further submitted that the said construction is being made without leaving the mandatory setbacks and ventilation space, thereby causing inconvenience to the neighboring residents and posing safety concerns. It is stated that on noticing the illegal construction activity, the petitioner submitted complaints dated 07.04.2026, 15.04.2026 and 20.04.2026 to respondent Nos.2 and 3 requesting them to take immediate action against respondent No.4 and to prevent the continuation of the unauthorized construction. According to the petitioner, despite receipt of the said complaints, respondent Nos.2 and 3 failed to initiate any action against respondent No.4 and remained silent spectators to the ongoing construction activity. It is further stated that respondent Nos.2 and 3, being statutory authorities under the provisions of the GHMC Act, are duty bound to prevent unauthorized constructions and take action in accordance with Sections 452 and 461-A of the GHMC Act.

Though several grounds are raised in the writ petition, learned counsel for the petitioner confines his submissions to the limited extent of seeking a direction to respondent Nos.2 and 3 to consider the complaints submitted by the petitioner dated 07.04.2026, 15.04.2026 and 20.04.2026 and to take appropriate action in accordance with law against the illegal and unauthorized construction being undertaken by respondent No.4.

Learned standing counsel for GHMC submits that to the extent of the consideration of complaint made by the petitioner, the respondent authorities would consider the same and pass appropriate orders in accordance with law. 6. It is not out of place to mention Section 7(6) of the Telangana State Building Permission Approval and Self Certification System (TS-BPASS) Act, 2020 (for short ‘the TS-BPASS Act’) which also encourages citizens to put on notice to the Civic Authorities regarding unauthorized constructions.
