ORDER:

Heard Sri Mohd Nazeeruddin Khan, learned counsel for the petitioner, Sri N. Sreedhar Reddy, learned Standing Counsel for TGSPDCL, for respondent Nos.2 to 5 and Sri M.S.Avinash Yadva, learned counsel for respondent No.6. Perused the entire record.

2. The writ petition is filed under Article 226 of the Constitution of India with the following prayer:

“…to issue an order, direction or Writ more particularly in the nature of mandamus declaring the inaction of respondent Nos.2 to 5 on the representation of Petitioner Dt.20.02.2026 and Dt. 05.12.2025 and their action in continuing to process the electricity connection and issuance of transformer to the Respondent No.6, despite the orders of this Court in preventing the Respondent No.6 from proceeding with illegal construction in WP No. 30519 of 2025 Dt.08.10.2025 as illegal and abuse of official position to favour a person who is at wrong, arbitrary, high handed, in violation of principles of natural justice and in contravention of provisions of Indian Electricity Act, apart from being violative of article 14 and 21 of the Constitution of India and with a consequent direction to the respondent No.2 to 5 to not to not grant any electricity connection to the application preferred by the Respondent No.6 by considering the representations of the petitioner Dt. 05.12.2025 and 20.02.2026, and to pass such other order or orders…”

3. The case of the petitioner is that respondent No.6 sought building permission for construction of a residential property in plot Nos.1 to 5 in Survey No.407/A of Tellapur Village and Municipality. The said application was processed and respondent No.6 was issued with building permit order No.005527/BP/DTCP/3120/0025/2021 dated 22.12.2021 for construction of stilt for parking plus two upper floors of the residential building. Respondent No.6, instead of building a residence, started construction of commercial complex without leaving any setbacks and also started construction of an additional floor. Since the construction was illegal, one of the landowners who offered the property for development filed W.P.No.40334 of 2022 and said the writ petition was disposed of directing the GHMC to consider the representation of petitioner therein dated 10.10.2022 and to pass appropriate orders in accordance with law within a period of 6 weeks. Upon receipt of said order, the Commissioner, Tellapur Municipality, issued notice to writ petitioner in W.P.No.40334 of 2022 and respondent No.6 herein. After conducting enquiry, it was found that the entire construction is without setbacks as approved in the sanction plan and the construction work was done in the earmarked play area. Therefore, the Commissioner of Tellapur Municipality cancelled the permission by exercising the powers vested in him under Section 176(9) of Telangana Municipal Act, 2019. Respondent No.6 stopped construction for some time and thereafter, started the construction in the year 2025 at a rigorous speed.

4. The writ petitioner approached High Court basing on representation made by him on 19.09.2025 vide W.P.No.30519 of 2025. A Coordinate Bench of this Court granted interim order on 08.10.2025 directing respondent No.3 therein i.e., GHMC to stop the construction activity undertaken by respondent No.4 therein i.e., respondent No.6 herein in the subject property and to file the compliance report. In spite of said orders, respondent No.6 herein continued with the construction with the cooperation of the Commissioner, Tellapur Municipality.

The petitioner pleaded that the construction taken up by respondent No.6 is in clear violation of the building permission obtained due to construction of extra floor and not leaving setbacks apart from the nature of building being commercial when permission was for a residential purpose.
