Heard learned counsel for the petitioner and Sri Midde Arun Kumar, learned Standing Counsel appearing for respondent Nos.2 to 5. With the consent of the parties, the writ petition is being taken up for disposal at the admission stage itself.

2. This writ petition has been filed seeking the following prayer:-

“to issue a Writ, Order or Direction more particularly one in the nature of “Writ of Mandamus” by declaring the action of the Official Respondent Nos.1 to 5 more particularly the Respondent No.2 to 5 in spite of receiving Petitioners Written Complaint dt. 24-04-2026 and 24- 09-2025 in not taking necessary action against the Unofficial Respondent Nos.6 who have carried out unauthorized construction in House Property bearing Municipal No. 9-4-76/11, Situated at Al Hasanth Colony, Tolichowki, Hyderabad, admeasuring 300 Sq. Yards, without any sanction plan and without leaving any mandatory setbacks, as arbitrary, discriminatory, ex- facie illegal, highhanded, and giving colorable exercise to its statutory powers which is in violation of principles of natural justice and consequently may direct the Official Respondent Nos.1 to 5 more particularly the Respondent No.4 & 5 to take necessary action on the Petitioner said Written Complaint dt. 24- 04-2026 and 24-09-2025 by demolishing the said unauthorized construction in House Property bearing Municipal No. 9-4-76/11, Situated at Al Hasanth Colony, Tolichowki, Hyderabad admeasuring 300 Sq. Yards, without any sanction plan and without leaving any mandatory setbacks, carried out by the Unofficial Respondent Nos.6, in the interest of justice and may pass such other Order or Orders as this Hon’ble Court may deem fit and proper in the circumstances of the case....”

The case of the petitioner, in brief, is that the petitioner is the resident of Syed Nagar, 1st Lancer, Hyderabad, and is aggrieved by the inaction of respondent Nos.2 to 5 in not considering the representations submitted by the petitioner regarding unauthorized construction being undertaken by respondent No.6 at premises bearing Municipal No.H.No.9-4-76/11, Al Hasanth Colony, Tolichowki, Hyderabad. It is the specific case of the petitioner that respondent No.6 is carrying out construction of Cellar + Ground + Four Upper Floors and Pent House without obtaining permission from the GHMC authorities and is making construction in violation of the Building Rules and the provisions of the GHMC Act without leaving mandatory setbacks and open spaces and further encroaching upon the adjoining road/footpath area. The petitioner had submitted representations dated 24.09.2025 and 24.04.2026 to respondent Nos.2 to 5 requesting them to take action against the alleged unauthorized construction activity. However, despite receipt of the said representations, the official respondents have failed to act upon the same till date. Questioning the said inaction, the petitioner filed the present writ petition.

Though several grounds are raised in the writ petition, learned counsel for the petitioner confines his submissions to the limited extent of seeking a direction to respondent Nos.2 to 5 to consider the complaints made by the petitioner dated 24.09.2025 and 24.04.2026 and to take appropriate action in accordance with law against the illegal and unauthorized construction being undertaken by respondent No.6.
