ORDER:

1. This writ petition is filed seeking direction to the respondent Corporation to cause inspection of the dilapidated building, which is 100 year old, adjoining the petitioner’s house situated at Esamiya Bazar, Koti, Hyderabad and take immediate steps to demolish the said 100 year old building by following the procedure contemplated under Sections 459 and 456 of GHMC Act, 1955.

2. The facts giving rise to the filing of this writ petition are as follows:

The petitioner is the resident of premises bearing No.4-6-311/2/a/1 at Esamiya Bazar near Koti, Hyderabad. It is submitted that there is an old dilapidated building (private party), which belongs to respondents i.e. respondent Nos.11 to 14 bearing M.No.4-6-693 (old), 4-6-493/1 to 4-6-493/4, 4-6-494, 4-6-494 (Part), 4-6-495, 4-6-496, 4-6-498, 4-6-499, 4-6-499/1, 4-6-411/1, 4-6-293, 4-9-293/1, 4-6-311/1, (old No.4-6-193) 4-6-311/2, 4-6-497, 4-6-493/3 and 4-6-493/5, adjoining the petitioner’s house premises. It is further submitted that the subject building is nearly 100 years old and is in a dilapidated condition. Due to the said condition of the subject building, the petitioner made representations to respondent No.2 – Deputy Commissioner, GHMC, Circle No.14, Goshamahal, Hyderabad on 13.01.2026, 20.02.2026 and 15.04.2026 requesting to inspect the subject building and to demolish the same. As the petitioner’s representations are not acted upon till date, the present writ petition is filed.

3. Learned counsel for the petitioner submits that since petitioner’s representations dated 13.01.2026, 20.02.2026 and 15.04.2026 are still pending for consideration, the respondent authorities may be directed to consider the same and take action in a time bound period.

On the other hand, learned Standing Counsel appearing for the respondent Nos.2 to 4 would submit that the petitioner’s representations dated 13.01.2026, 20.02.2026 and 15.04.2026 will be considered, if not already considered, and appropriate action would be initiated, in accordance with law, and prays this Court to pass appropriate orders.

5. Heard learned counsel for the petitioner and Mr. M.Arun Kumar, learned Standing Counsel for GHMC appearing for respondent Nos.2 to 4.

6. In case on hand, it is pertinent to refer to some of the relevant Sections of GHMC Act, 1955, the same are extracted hereunder:-

Section 433 of GHMC Act, 1955

433. Notice to be given to the Commissioner of intention to make additions, etc., :- “Every person who shall intend.

(a) to make any addition to a building; or

(b) to make any alteration or repairs to a building; not being a frame-building, involving the removal or re-erection of any external or party-wall thereof or of any wall which supports the roof thereof, to an extent exceeding one-half of such wall above the plinth level, such half to be measured in superficial feet; or

(c) to make any alteration or repairs to a frame building, involving the removal or re-erection of more than one-half of the posts in any such wall thereof as aforesaid or involving the removal or re-erection of any such wall thereof as aforesaid to an extent exceeding one-half of such wall above the plinth level, such half to be measured in superficial feet; or

(d) to make any alteration in a building involving:—

(i) the sub-division of any room in such building so as to convert the same into two or more separate rooms.

(ii) the conversion of any passage or space in such building into a room or rooms; or

(e) to remove or reconstruct any portion of a building abutting on a street which stands within the regular line of such street; shall give to the Commissioner in a form obtained for the purpose under section 435 notice of his intention, specifying the portion of the building in which such work is to be executed, the nature and extent of the intended work, the particular part or parts, if any, of such work which is or are intended to be used for human habitation and the name of the person whom he intends to employ to supervi
