ORDER:

This writ petition is filed, declaring the respondents’

failure to pay the petitioner’s salary for the period from 10.11.2004 to October 2007 as illegal and arbitrary, and consequently direct the respondents to pay the salary for the said period.

2. The brief facts of the case are as follows:-

(a) The petitioner was appointed as a Conductor in the year 1996, and her services were regularized with effect from 01.01.1998. On 09.10.2004, while the petitioner was discharging her duties as a Conductor, pain began in her leg, and she was unable to continue her duties. Therefore, the petitioner made an oral request to the respondent authorities seeking two days’ leave. However, the Depot Manager instructed the petitioner to complete the trip.

(b) After completing her duty, the petitioner went for a medical check-up. The doctors advised her to take a rest. However, she did not recover from the pain. Therefore, the petitioner went to Sai Krishna Super S
