The Court directed the respondent authorities to consider and decide upon the petitioners' representations for agricultural loan waiver under the Rythu Bandhu Scheme within a stipulated period of two weeks.

ORDER

Heard Sri R. Chandrashekar Reddy, learned counsel appearing on behalf of the petitioners, learned Assistant Government Pleader for Finance appearing on behalf of respondent No.1 and the learned Assistant Government Pleader for Agriculture appearing on behalf of the respondent Nos.2 to 5 and Sri M. Srikanth Reddy, learned Standing Counsel for SBI appearing on behalf of respondent No.6.

2. The petitioner approached the Court seeking prayer as under:

“…to issue a Writ, Order or direction more particularly one in the nature of Writ of Mandamus declaring action of the Respondents No.2 to 5 more particularly Respondent No.3 and 4 in not considering the representations dated 18.11.2025 made by the petitioners, with respect to the grant of benefits under the Rythu Bandhu Scheme/Agricultural Loan Waiver Scheme introduced by the then Government, as illegal, arbitrary, unjust and Violative of rights guaranteed under Article 14 and 21 of the Constitution of India apart from violation of principles of natural justice, and consequently direct the Respondent No.3 and 4 to consider the representations dated 18.11.2025 made by the petitioners for the grant of benefits under the Rythu Bandhu Scheme/Agricultural Loan Waiver Scheme introduced by the then Government in accordance with law within a stipulated period; and to pass such other order or orders as this Hon'ble court may deem fit and proper in the interest of justice…”

3. The case of the petitioners in brief as per the averments made in the affidavit filed by the petitioner in support of the present Writ Petition is as under:-

i) The petitioners are marginal farmers of Siddipet District. The petitioners availed crop loans from SBI (ADB) Bank, Siddipet Branch, bearing Loan Account Nos. 36084287239 for Rs.2,00,000/- and 36075791442 for Rs.2,98,000/-.

ii) The State Government introduced the Rythu Bandhu Scheme / Agricultural Loan Waiver Scheme for waiver of crop loans up to Rs.2,00,000/-, under which the petitioners are eligible beneficiaries.

iii) Though the petitioners submitted a representation dated 18.11.2025 to the respondent authorities, no action has been taken by the respondents till date. Aggrieved by the same, the petitioners approached this Court by filing the present writ petition.

DISCUSSION AND CONCLUSION:

4. Learned counsel appearing on behalf of the petitioners mainly puts forth the following submissions:

4.1 The petitioners had obtained crop loans from respondent Bank for cultivation purposes under the Rythu Bandhu Scheme / Agricultural Loan Waiver Scheme.

4.2 The petitioners herein are eligible to avail the benefit under the said scheme. The petitioners have also submitted a representation dated 18.11.2025 to the respondent authorities seeking waiver of the petitioners’ crop loans. However, no action has been taken on the said representation till date.

4.3 The petitioners have also approached the concerned revenue authorities, including the Mandal Revenue Officer and Village Administrative Officer, by submitting representations. However, no action has been initiated on the said representations till date.

4.4 Due to non-waiver of the agricultural loans, the respondent Bank is continuing to demand repayment and is threatening to levy interest and initiate recovery proceedings against the petitioners. Hence, it is just and necessary that appropriate orders be passed directing the respondents to extend the benefit of loan waiver to the petitioners and to ensure that the waiver amount is credited to their respective loan accounts.

Based on the aforesaid submissions, learned counsel appearing on behalf of the petitioners contends that the petitioners are entitled to the relief as prayed for by the petit
