ORDER

Heard Sri Nagaraju Naguru, learned counsel appearing on behalf of the petitioners, learned Assistant Government Pleader for Minorities Welfare appearing on behalf of the respondent No.1, Sri Farhan Azam Khan, learned Standing Counsel for Wakf Board appearing on behalf of respondent Nos.2 and 7 and learned Assistant Government Pleader for Revenue appearing on behalf of respondent Nos.3 to 6.

2. The petitioners approached the Court seeking prayer as under:

“…to issue appropriate Writ, Order or direction more particularly one in the nature of the WRIT OF MANDAMUS declaring the actions of the respondents failed to consider the representations DT: 27-03-2025, 15-04-2025, 19-08-2025, 09-09-2025 & 22-12-2025 (submitted on un-register committee namely Khammam District Waqf Lands Protection & Muslims Women Adahoc Committee, Khammam) for granting house-sites on lease basis for an extent of 100 Sq. Yards to each poor muslim women committee members in Ashoorkhana Badeshahi inside Fort, Gollagudem Village, Khammam Urban Mandal, Khamma District(Wakf Land) as arbitrary, illegal against Art. 19, 21 & 300-A of the Constitution of India and consequentially direct the respondents to grant house-site pattas to the petitioner committee members on lease basis and to pass such other order or orders as this Hon'ble Court may deems fit just and proper in the circumstances of the case.”

3. The case of the petitioners in brief as per the averments made in the affidavit filed by the petitioners in support of the present Writ Petition is as under:-

The petitioners are the members of the unregistered society known as the “Khammam District Waqf Lands Protection and Muslim Women Adhoc Committee". The petitioners are poor landless Muslim women represented by an unregistered committee and the petitioners seek allotment of house sites on a lease basis in Waqf lands attached to Ashoorkhana Badeshahi at Gollagudem/Velugumatla Village, Khammam Urban Mandal. Despite the lands being notified as Waqf properties meant for charitable purposes and in spite of several representations made since 2016, no action had been taken by the authorities. Aggrieved by the same, the petitioner approached this Court by filing the present writ petition.

DISCUSSION AND CONCLUSION:

The limited relief as sought for by the petitioners in the present w rit petition is a direction to Respondent Nos.2 and 3 to consider the petitioners’ representations dated 27.03.2025, 15.04.2025, 19.08.2025, 09.09.2025, and 22.12.2025 for grant of house sites on a lease basis, to an extent of 100 square yards each, to the poor Muslim w omen committee members in Ashoorkhana Badeshahi, situated inside the Fort at Gollagudem Village, Khammam Urban Mandal, Khammam District.

5. Learned counsel appearing on behalf of the petitioners mainly puts forth the follow ing submissions:

5.1 The petitioners have been submitting representations to the respondents for the past two decades seeking grant of leases, so as to provide accommodation to more than 2000 Muslim women on a lease basis.

5.2 Respondent No.2 issued directions to Respondent No.7 vide memo dated 03.07.2006 to conduct a spot inspection of Gollagudem Village and submit a factual report. However, no action has been taken by Respondent No.7 as on date.

5.3 Though the representations of the petitioners were addressed to Respondent Nos.2 and 3 and were duly acknowledged by their offices, no action has been taken so far.

Based on the aforesaid submissions, learned counsel appearing on behalf of the petitioners contends that the petitioners are entitled to the relief as prayed for by the petitioners in the present w rit petition.

Learned Standing Counsel for Respondent No.2 – Waqf Board contends that appropriate orders may be passed on the representations submitted by the petitioners to Respondent Nos.2 and 3, seeking grant of house site pattas to the members of the petitioners committee, in accordance to law, within a reasonabl
