ORDER:
This writ petition is filed questioning the action of the respondents in not referring petitioner’s representation/application dated 12.06.2021 (received on 18.06.2021) to the Authority under Section 64 of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (for short ‘the Act’) for adjudication and determination of the compensation payable to the petitioner with reference to acquisition of the petitioner’s land in Sy.Nos.802/EE admeasuring Ac.2-04 guntas, Sy.No.803/UU admeasuring Ac.4-05 guntas, Sy.No.804/UU admeasuring Ac.0-30 guntas and Sy.No.805/RU admeasuring Ac.1-38 guntas and Sy.No.817/B admeasuring Ac.1-26 guntas respectively, total extent Ac.10-23 guntas situated at Polepalli Village, Jadcherla Mandal, Mahabubnagar District (hereinafter referred as ‘subject property’). A consequential prayer is sought seeking direction to respondent authorities to refer the application of the petitioner dated 12.06.2021 (received on 18.06.2021) to the Authority under Section
64 of the Act.
2. Brief facts of the case as stated are that the petitioner claims to be the absolute owner, possessor and pattedar of the subject property. The Government to provide irrigation and drinking water facility, initiated construction of Palamuru-Ranga Reddy Lift Irrigation Scheme Project, in which the lands of the Polepalli village and other villages were acquired vide Notification issued under Act 30 of 2013. It is further submitted that since no award was passed, petitioner along with two others have approached the Hon’ble High Court and filed W.P.No.20046 of 2020 and this Court by order dated 11.11.2020 disposed of the said writ petition by recording the submissions of learned Special Government Pleader that the Government would follow due procedure as contemplated under the Act and will conduct Award enquiry as per the provisions of the Act and after paying the compensation to the petitioners, they would take possession of the subject property. It is further submitted that in view of non- compliance of directions issued in W.P.No.20046 of 2020 by the respondent authorities therein, petitioner had filed Contempt Case No.612 of 2021 and when the said case is pending, some amounts were credited into the bank account of petitioner on 10.06.2021 without conducting Award enquiry and without serving notice. It is further submitted that the in view of non-compliance of directions issued by this Court in W.P.No.20046 of 2020 by the respondent authorities therein and crediting the compensation amount to the bank account of the petitioner on 10.06.2021 without there being any Award enquiry and without serving any notice, petitioner submitted a representation on 12.06.2021 (received on 18.06.2021) to the District Collector, Mahabubnagar/respondent No.2 requesting to refer the case of the petitioner to the appropriate Authority under Section 64 of the Act, but till date the said application/representation was not considered. Aggrieved by the said inaction, the present writ petition is filed.
3. Learned counsel for the petitioner submits that since petitioner’s representation dated 12.06.2021 is still pending for consideration, the respondent authorities may be directed to consider the same and take action in a time bound period.
