ORDER:
This writ petition is filed questioning the action of the respondents in failing to disburse the land acquisition compensation to the petitioners in respect of land bearing in Sy.No.51/2 admeasuring Ac.2-00 guntas and Sy.No.51/4 admeasuring Ac.2-00 guntas situated in Nagireddypally Village, Maheshwaram Mandal, Rangareddy acquired by the Government of Telangana as being illegal, arbitrary, violation of Articles 14 and 300-A of the Constitution of India and seeking a consequential direction to respondent No.2 to forthwith disburse the land acquisition compensation equally to the petitioners along with all statutory benefits.
2. Brief facts of the case as stated are that one late K. Ganiya had four sons and two daughters and petitioner Nos.1 to 3 and respondent No.5 are the sons of late K. Ganiya and during the life time of late K.
Ganiya, Government assigned ceiling Patta land admeasuring Ac.4-00 guntas in Sy.No.51/2 and 51/4 in favour of late K. Ganiya and respondent No.5 (each Ac.2-00 guntas) and since respondent No.5 was major at the time of assignment of said land, respondent No.5 assigned Ac.2-00 guntas (part of Ac.4-00 guntas) of land in Sy.No.51/4. It is further submitted that respondent No.2 notified Form-C under Section 11 of the Land Acquisition Act in respect of total extent of Ac.198.21 guntas in Nagireddypally village, Maheshwaram Mandal, Rangareddy District for establishment of Industrial Park/I.T.Park vide proceedings No.D/2730/2018 dated 01.02.2025 in respect of land in Sy.No.51/4 in which the respondent No.5 is shown as Pattedar and in Sy.No.51/2 shown as Kharjikhata but the extent is owned by late K. Ganiya. It is further submitted that the petitioners and respondent No.5 being sons of late K. Ganiya as legal heirs they are entitled for equal share in the Sy.No.51/2 and 51/4 for land admeasuring Ac.4-00 guntas in Nagireddypally village, Maheshwaram Mandal, Rangareddy District and for claiming such equal share, petitioners have submitted an application dated 06.01.2026 to the respondent authorities but, the same was not attended to by the respondent authorities till date. Aggrieved by the said inaction, the present writ petition is filed.
3. After arguing at length, learned counsel for the petitioners submits that they would take steps to mutate their names in the revenue records and thereafter make representation to the land acquisition authorities.
4. Recording the submissions made by the learned counsel for the petitioners, without expressing any opinion on the merits of the case, this Court deems it appropriate to dispose of the writ petition granting liberty to the petitioners to pursue their remedies as available under law.
5. With the above directions, this writ petition is disposed of.
There shall be no order as to costs.
As a sequel thereto, miscellaneous applications if any pending in this petition, shall stand closed.
