Heard Sri D.Vijay Kumar, learned counsel appearing on behalf of the petitioner, learned Standing Counsel for the Waqf Board appearing on behalf of respondent No.2 and Sri Mohd Asifuddin, learned counsel appearing on behalf of respondent Nos.4 to 12.
2. The petitioner approached the Court seeking prayer as under:
“…to issue any writ, or order or direction more particularly one in the nature of writ of Mandamus, declaring the proceedings bearing F.No.
01/SDPT/MC/2026/Z-IV, dated 27-02-2026 issued by the Chief Executive Officer, Telangana State Waqf Board i.e. Respondent No.2 as highly illegal, arbitrary, colorable exercise of power, abuse of process of law, abuse of power entrusted by law, abuse of official capacity and position, violation of Principles of Natural Justice, unconstitutional, infringing of petitioners fundamental and legal rights apart from violative of The Waqf Act, 1995 and The Andhra Pradesh Waqf Managing Committee (Constitution, Functions and Duties) Regulations, 2009 and consequentially set aside the proceedings bearing F.No. 01/SDPT/MC/2026/Z-IV, dated 27-02-2026 issued by the Chief Executive Officer, Telangana State Waqf Board i.e. Respondent No.2 and pass”
3. The case of the petitioner in brief as per the averments made in the affidavit filed by the petitioner in support of the present Writ Petition is as under:-
i) The Petitioner No.1 is a registered Society established in the year 2010, engaged in the management of mosques, Eidgah, and related religious and charitable activities in Siddipet. The Petitioner No.2 is the General Secretary of the said Society, duly authorized by resolution dated 21.12.2025 to represent the Society. The Society has been managing the Eidgah situated in Survey No.2212, Siddipet, a notified Waqf institution, and has been conducting religious activities including Ramzan and Bakrid arrangements for several decades.
ii) In view of the upcoming Ramzan 2026, the Petitioners constituted a proposed Eidgah Committee and submitted a representation dated 12.02.2026 to the Telangana State Waqf Board seeking constitution of an 18-member managing committee.
iii) However, without considering the said representation, without issuing notice, and without affording any opportunity to the Petitioner or concerned worshippers, the Respondent No.2 issued proceedings dated 27.02.2026 appointing an Adhoc Committee comprising Respondent Nos.4 to 12, allegedly based on another representation and a recommendation made by an Ex-MLC. Aggrieved by the same, the petitioner approached this Court by filing the present writ petition.
4. PERUSED THE RECORD:
A) The relevant portion of the impugned proceedings vide F.No.01/ SDPT/ MC/ 2026/ Z-I V dated 27.02.2026 issued by the respondent No.2-the Telangana State Waqf Board, is extracted hereunder:
“The Institution namely Eidgah in Sy No. 2212 situated at Siddipet Town and District is a notified Waqf and published in A.P. Gazette No.46-A dated: 15-11-2001 at Sl.
No.18503.
In the Ref 1st cited, Janab Mohd Ahteshamuddin Ahmed has submitted a representation wherein stated that a society under the name as Tanzeem Ul Masajid Eidgah Committee Siddipet registered under the society Act and the following intellectuals are the executive body of the society with a request to constitute the (8) Members Managing Committee.
Vide Ref 2nd cited the Inspector Auditor Waqf Siddipet District has enquired and reported that the subject Waqf Institution known as Eidgah in Sy No. 2212 and Graveyard is a notified Waqf got published in Gazette Nc. 46-A dated: 15-11-2001 and S. No. 18503, 18520 situated at Siddipet Town and District. Further reported that a representation
