Heard Smt. Rajasri Manche, learned counsel
appearing on behalf of the petitioner, learned Assistant Government Pleader for Revenue appearing on behalf of the respondent Nos.1, 3 to 6 and the learned Assistant Government Pleader for Forest appearing on behalf of the respondent Nos.2, 7 and 8.

2. The petitioner approached the Court seeking
prayer as under:
“…to Issue a Writ, Order, or Direction, more particularly one in the nature of Writ of Mandamus,
i) declaring the action of the 7th and 8th Respondents, in illegal interference with the petitioners peaceful possession and enjoyment of land admeasuring Ac.2.30 guntas in Sy.No. 836 of Repaka Village, Ellanthakunta Mandal, Rajanna Sircilla District, despite the same being recorded as patta land in the Petitioners name in revenue records (Pahani and ROR- 1B) since 1954-55 to till date, as illegal, arbitrary, without jurisdiction and violative of Article 300-A of the
Constitution of India,
ii) To Declare that the Forest Department cannot unilaterally alter the nature of land classified as Patta in Revenue Department records, or claim the same as Forest Land, in the absence of a Statutory Notification
under section 20 of the Indian Forest Act 1927,
iii) Consequently, to Direct Respondents 7 and 8 not to interfere with the Petitioner’s possession or dispossess the Petitioner from the said land, except by following due process of law, and to further restrain them from asserting any claim over Sy.No.836 without lawful
proceedings or a valid Reserve Forest Notification,”
3. The case of the petitioner in brief as per the averments made in the affidavit filed by the petitioner
in support of the present Writ Petition is as under:-
i) The petitioner is the absolute owner and possessor of agricultural land admeasuring Ac.2-30 guntas in Sy.No.836

situated at Repaka Village, Ellanthakunta Mandal, Rajanna Sircilla District and has been in continuous peaceful possession and cultivating the said land by receiving Rythu
Bandhu benefits.
ii) In 2019, the Forest Officials began illegally interfering with the petitioner’s possession on the ground that the land forms part of a Reserve Forest. Aggrieved by the same, the petitioner approached this Court by filing the present writ
petition.
PERUSED TEH RECORED:
A) The relevant portion of the proceedings of the respondent No.5-I nspector of Survey, District Survey and Land Records, Rajanna Sircilla vide Letter No.A3/ 115/ 2023 dated 19.07.2023 addressed to the respondent No.3-the District Collector, Rajanna
Sircilla is extracted hereunder:
"I submit that, vide reference cited above, the applicant Sri Jadagala Thirupathi S/o Narsaiah has filed an application to demarcate the boundaries in respect of Sy. No. 836 situated at Repaka Village of
Ellanthakunta Mandal.

On verification of Land Records of Repaka Village of Ellanthakunta Mandal. The details are as follows-

I have proceeded to Repaka Village of Ellanthakunta Mandal, along with Forest Section Officer, conducted survey and demarcated the boundaries with the help of Village map and Tippons in respect of Sy.No. 836 to an extent Ac 5-20 Gt. And also conducted the Panchanama on spot in presence of the applicant, Adjacent Sy. No. Pattadars and Forest
Officials.
Further, the Forest Department officials saying that the land in respect of Sy.No 836 comes under Reserve Forest as per their co-ordinates. But, they have not shown any records on spot related to inclusion
of Sy No.836 patta land in Reserve Forest
