ORDER:

Heard Sri D.L.Pandu, learned counsel appearing on behalf of petitioner, learned Assistant Government Pleader for Animal Husbandry Department, appearing on behalf of respondent Nos.1, 2 and 4, learned Assistant Government Pleader for Revenue, appearing on behalf of respondent No.3 and learned Assistant Government Pleader for Home Department, appearing on behalf of respondent No.5.

The petitioner approached the Court seeking prayer as under:

“…to issue a writ or order or direction more particularly one in the nature of writ of Mandamus to declare the action of the respondents in not considering the representation of the petitioner dated 13.03.2026 in conducting skill test and granting membership in the Primary Fishermen Cooperative Society Limited, Angadi Kistapuram as illegal, arbitrary, unconstitutional, contrary to the G.O.Ms.No.98 dated 22.01.1964, G.O.Ms.No.74 dated 21.10.2011 and G.O.Ms.No.4 dated 04.07.2022 and G.O.Ms.No.6 dated 24.03.2016, violative of Principles of natural justice besides violative of Article 14 and 21 of the Constitution of India and consequently direct the respondents to act as per the GOs mentioned above to provide membership to the petitioners society in Primary Fishermen Cooperative Society Ltd., Angadi Kistapur Village, Markook Mandal, Siddipet District and pass such other order or orders has this Hon’ble Court may deem fit and proper in the circumstances of the case….”

The case of the petitioner, in brief, is that the petitioner is traditionally dependent upon fishing for livelihood, and is seeking membership in the Primary Fishermen Cooperative Society Limited, Angadi Kistapuram. Earlier, the petitioner and others filed W.P.No.17465 of 2025, wherein this Hon’ble Court by order dated 20.08.2025 directed the respondents to consider their representation for conduct of skill test and grant of membership. Pursuant thereto, the respondents conducted a skill test on 26.09.2025 for 90 applicants, out of which only 33 persons were granted membership, while the petitioner and other similarly situated persons were excluded. Aggrieved thereby, the petitioner submitted representation dated 13.03.2026 requesting conduct of fresh skill test and grant of membership. Since no action has been taken on the said representation till date, the present writ petition is filed.

PERUSED THE RECORD

DISCUSSION AND CONCLUSION:

Learned counsel appearing on behalf of the petitioner mainly puts-forth the following submissions:-

a) The petitioner belongs to Mudiraj Community and is traditionally dependent on fishing for livelihood, in Cheberthy Village, Markook Mandal, Siddipet District.

b) On an earlier occasion, the petitioner approached this Court by filing W.P.No.17465 of 2025, seeking consideration of petitioner’s representation requesting conduct of fresh skill test for grant of membership and this Court vide order dated 20.08.2025, had directed the respondents to consider the petitioner’s representation in the light of the Expert Committee Report dated 26.04.2024 and pass appropriate orders within a stipulated time.

c) In pursuance to the directions of this Court dated 20.08.2025 passed in W.P.No.17465 of 2025, the respondent authorities conducted a skill test on 26.09.2025 for 90 applicants, but, however, only 33 persons were declared qualified and granted membership in the primary Fishermen Co-operative Society, Angadi Kistapur.

d) The remaining members were left-out, despite belonging to the same Mudiraj Community and being similarly situated. Hence, the petitioner is also entitled to the benefit of the order of this Court dated 20.08.2025 passed in W.P.No.17465 of 2025.

e) Thereafter, the petitioner had submitted a detailed representation dated 13.03.2026 to the 4th respondent requesting conduct of fresh skill test and grant of membership to remaining persons who had been ignored.
