ORDER

The petitioner-accused No.2 filed the present application

under Sections 480 and 483 of Bharatiya Nagarik Suraksha Sanhita,

2023, seeking to grant bail to him in Crime No.107 of 2022 of

Asifabad Police Station, KBM Asifabad District, registered for the

offences punishable under Section 103(1) the of Bharatiya Nyaya

Sanhita, 2023 (for short ‘BNS’).

2. The brief facts of the case are that since the deceased was

continued to maintain love affair with the daughter of accused

No.1 even after warning him several times, the accused No.1 along

with accused No.2 conspired and strangulated the deceased to

death. Hence, a case was registered against the accused.

3. Heard Mr. D. Pochaiah, learned counsel for the petitioner

and Mr. Vivekananda Reddy, learned Assistant Public Prosecutor

appearing for the respondent-State.

4. Learned counsel for the petitioner submitted that the

petitioner was falsely implicated in the case. He further submitted

that the petitioner is ready to cooperate with the investigation.

Hence, he prayed the Court to grant bail to the petitioner by

allowing the Criminal Petition.

5. On the other hand, learned Additional Public Prosecutor

opposed to grant bail to the petitioner stating that the petitioner is

arraigned as accused No.2 and he also took active part in killing

the deceased. He further submits that the investigation is yet to

be completed. Hence, he prayed the Court to dismiss the Criminal

Petition.

6. In the light of the submissions made by both the learned

counsel and considering that serious allegations are levelled

against the petitioner and the investigation is yet to be completed,

this Court is of the considered view that it is not a fit case for

granting bail to the petitioner at this stage.

7. Accordingly, the Criminal Petition is dismissed.

Miscellaneous applications, if any pending, shall stand

closed.
