ORDER

This Writ Petition is filed seeking to grant the following relief:

“to issue an appropriate Writ, Order or Direction, more particularly one in the nature of Writ of Mandamus declaring the action of the respondents in trying to demolish the residential houses of the petitioners, on 17/05/2026 D.No.4-38/A, D.No.2-38/1, D.No.2-38, D.No.2-64 and D.No.4-36, situated at Mudigonda Village and Mandal, Khammam District, covered by Electricity Service Connection No.210101310 bearing USC No.13108659, Electricity Service Connection No.30801-02082 bearing USC No.10293579, Electricity Service Connection No.30801-00602 bearing USC No.10292341, Electricity Service Connection No.30001-02720 bearing USC No.16388720 and Electricity Service Connection No.30801-01360 bearing USC No.10292970, respectively, without issuing notice, without initiating acquisition proceedings, without payment of compensation and without following due process of law, as illegal, arbitrary, unconstitutional and violative of Articles 14, 21 and 300-A of the Constitution of India and consequently direct the respondents not to interfere with or demolish the residential houses of the petitioners, except by following due process of law and pass any such other order or orders which this Hon'ble Court may deem fit and proper in the circumstances of the case.”

2. Heard Sri Konduru Laxmikanth, learned counsel for the petitioners, learned Assistant Government Pleader for Roads and Buildings appearing for respondent Nos.1, 5, 6, 7 and 8, and learned Assistant Government Pleader for Revenue appearing for respondent Nos.2 to 4.

Learned counsel for the petitioners submits that the petitioners are the long-time residents of Mudigonda Village, Khammam District and residing in their respective houses and possessing documentary proof, such as, electricity connections, Aadhaar cards, ration cards, house tax receipts, and other records. The respondents, under the guise of the proposed road widening from Mudigonda to Vallabhi, attempted to demolish the petitioners' residential houses by deploying JCBs, machinery, and police force without issuing any notice, and without initiating land acquisition proceedings and paying compensation, or providing rehabilitation. Despite representation dated 20.05.2026 submitted to the respondent authorities seeking protection against illegal demolition, no action has been taken. Aggrieved thereby, the petitioners have filed the present writ petition.

4. On instructions, the learned Assistant Government Pleader for Roads and Buildings submits that, if any land belonging to the petitioners is required for the purpose of road widening, the respondents would follow the due process of law.

In the facts and circumstances of the case, without going into the merits of the matter, the Writ Petition is disposed of, directing the respondents not to interfere with the petitioners’ properties, including demolition, except by following due process of law including the provisions of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 to acquire the affected portion of the properties and pay compensation, if any. In the event the respondents propose to take any action affecting the petitioners’ possession or enjoyment of the lands, they shall issue notice to the petitioners, afford them a reasonable opportunity of hearing and, after conducting a proper enquiry, shall pass appropriate orders in accordance with law. There shall be no order as to costs.

As a sequel, miscellaneous petitions pending, if any, shall stand closed.
