Scientia Infocom India Pvt. Limited – Appellant
Versus
State of Telangana – Respondent
WRIT PETITION No.15480 of 2026
For the Appellants/Petitioners: M.V.S. Suresh Kumar, M.V. Pratap Kumar
For the Respondents: G. Madhusudhan Reddy
Property tax assessment or reassessment under Section 225(4) of the Greater Hyderabad Municipal Corporation Act, 1955, requires the issuance of a notice and providing the affected party an opportunity for a hearing to comply with the principles of natural justice.
Headnote:The petitioner challenged a property tax demand notice issued under the Greater Hyderabad Municipal Corporation Act, 1955, specifically citing Section 225(4). The petitioner, owning land in Vattinagulapally Village, contested a demand of Rs. 98,42,022 for the year 2025-2026, alleging that the revised demand notice was issued without considering their explanation or providing a hearing. The court found that the principles of natural justice must be followed during tax assessment. The primary issue was whether the tax demand notices were issued in violation of the principles of natural justice and the statutory requirement of Section 225(4) of the Greater Hyderabad Municipal Corporation Act, 1955. The court reasoned that the Commissioner may assess or reassess the property tax only after issuing notice and affording an opportunity to the affected party to submit their objections to the proposed action. Accordingly, the writ petition is disposed of.
ORDER:
