Aggrieved by the action of respondent No.2 in issuing the

Memo.Nos.E3/547/2022 & E3/548/2022, both dated 25.04.2022,

thereby, refusing to grant No-Objection Certificate for alienation of the

property admeasuring an extent of Ac.2-20 gts., each in Sy.No.287/1 &

287/2, situated at Khajipur Village, Kothapalli Mandal, Karimnagar

District, and seeking a direction to respondent No.3 to receive and register

the sale deeds presented by the petitioners in respect of the subject

property, in light of G.O.Ms.No.1117 dated 11.11.1993, the present writ

petition is filed.

2. Heard Sri Srinivasa Rao Puttuluri, learned counsel appearing for the

petitioners, and learned Government Pleader for Assignment, appearing on

behalf of the respondents.

3. Learned counsel for the petitioners submits that one

Mr. S.M. Laxman Babu, who was an ex-serviceman, had rendered his

services for the nation for almost (24) years, and was discharged from

service on 30.11.1989. Thereafter, he made an application dated

15.07.1998, for allotment/assignment of agricultural land under ex-

serviceman category, and in terms of the existing policies under

G.O.Ms.No.1724 dated 26.08.1958 r/w. G.O.Ms.No.1406 dated

25.07.1958, he was accorded the sanction of patta. In pursuance thereof,

respondent No.3-Tahsildar issued the final patta certificate in

No.B1/2037/2001 dated 15.04.2003, assigning the subject land in favour

of Mr. S.M. Laxman Babu. It is submitted that the Government had earlier

issued orders in G.O.Ms.No.1117 dated 11.11.1993, for alienation of lands

assigned in favour of ex-servicemen, wherein, it was classified that they

are free to sell away the assigned lands after a period of ten years. Upon

expiry of the said ten years period, in order to meet his immediate

expenses and other necessities of his family, Mr. S.M. Laxman Babu

offered to sell his land to the petitioners. As such, since the condition for

alienation had lapsed by 14.04.2013, the petitioners accepted his offer,

and got the sale deeds registered in their favour in respect of land

admeasuring an extent of Ac.2-20 gts., each, in Sy.Nos.287/1 & 287/2,

situated at Khajipur Village, Kothapalli Mandal, Karimnagar District, vide

Doc.Nos.3028/2013 & 3029/2013, both dated 25.09.2013. Subsequently,

their names were also mutated in the revenue records, and since then, the

petitioners have been in peaceful possession and enjoyment of the subject

land. However, in dire necessity of money, the petitioners decided to

dispose off the subject land and their offer was also accepted by a

prospective purchaser/third party. As such, the petitioners approached

the office of respondent No.3 and they were informed to obtain a No-

Objection Certificate from respondent No.2 for alienation.

4. It is further submitted that the petitioners submitted their

application for grant of No-Objection Certificate on 15.02.2022. However,

by erroneously placing reliance upon the orders issued in G.O.Ms.No.307

dated 06.06.2013, respondent No.2 passed the impugned Memos, both

dated 25.04.2022, rejecting their request for grant of a No-Objection

Certificate, which are wholly illegal, arbitrary, unjust and unsustainable,

inasmuch as the subject land was assigned to an ex-serviceman as a

grant, which is alienable after a period of ten years as per the orders

issued in G.O.Ms.No.1117 dated 11.11.1993. However, without verifying

the same, respondent No.2 has taken a different view, relying upon

G.O.Ms.No.1117 dated 11.11.1993, obtaining a No-Objection Certificate
