COMMON ORDER:
1. W.P.No.32672 of 2016 is filed seeking the following relief:
“…to issue writ or direction preferably Writ of mandamus declaring the impugned order dated 08-09-2016 in Rc.No.E3/1496/2009/ROR-22 issued by the 3rd respondent in the proceedings initiated against the 6th respondent to the extent it concerns land of the writ petitioners admg., Ac.2-00 & Ac.1-00 respectively in sy.No.17/1/E2, of Laxmidevipalli village of Kothagudem as illegal, arbitrary, contrary to record, without jurisdiction and violative of principles of natural justice, violative of Art.300 A of Constitution of India, the provisions of T.S. Record of Rights in Land & Pattadar Pass Books Act, and consequently set aside the impugned order dated 08-09-2016 in Rc.No.E3/1496/2009/ROR-22 to the extent it concerns the lands of writ petitioners and pass such other or further orders…”
W.P.No.32675 of 2016 is filed seeking the following relief:
“…to issue writ or direction preferably Writ of mandamus declaring the impugned order dated 08-09-2016 in Rc.No.E3/1496/2009/ROR-1 issued by the 3rd respondent in the proceedings initiated against the 6th respondent to the extent it concerns land of the writ petitioner admg., Ac.4-00, in sy.No.17/1/E1, of Laxmidevipalli village of Kothagudem as illegal, arbitrary, contrary to record, without jurisdiction and violative of principles of natural justice, violative of Art.300 A of Constitution of India, the provisions of T.S. Record of Rights in Land & Pattadar Pass Books Act, and consequently set aside the impugned order dated 08-09-2016 in Rc.No.E3/1496/2009/ROR-1 to the extent it concerns the lands of writ petitioner and pass such other or further orders…”
W.P.No.32723 of 2016 is filed seeking the following relief:
“…to issue writ or direction preferably Writ of mandamus declaring the impugned order dated 08-09-2016 in Rc.No.E3/1496/2009/ROR-1 issued by the 3rd respondent in the proceedings initiated against the 6th respondent to the extent it concerns land of the writ petitioner admg., Ac.3-00, in sy.No.17/1/E1, of Laxmidevipalli village of Kothagudem as illegal, arbitrary, contrary to record, without jurisdiction and violative of principles of natural justice, violative of Art.300 A of Constitution of India, the provisions of T.S. Record of Rights in Land & Pattadar Pass Books Act, and consequently set aside the impugned order dated 08-09-2016 in Rc.No.E3/1496/2009/ROR-1 to the extent it concerns the lands of writ petitioner and pass such other or further orders…”
2. Heard Mr. Kowturu Pavan Kumar, learned counsel for petitioners, Ms. Dara Haritha Kiran, learned Assistant Government Pleader for Revenue appearing for respondent Nos.1 to 5 and learned Assistant Government Pleader for Forests appearing for respondent No.7 in all these writ petitions.
3. In all these three matters, challenge is to the order of Joint Collector and Additional District Magistrate, Khammam, dated 08.09.2016, subject matter is similar (facts also). In W.P.No.32672 of 2016, there are two writ petitioners. W.P.Nos.32675 and 32723 of 2016 are filed by two different petitioners. In W.P.No.32723 of 2016, petitioner is Gavini Kalpana, who is also petitioner No.2 in W.P.No.32672 of 2016, but, the challenge is to a similar proceeding bearing a different proceeding number. Facts in W.P.No.32672 of 2016 are being referred.
4. This Court suo moto impleaded District Forest Officer as respondent No.7 vide order dated 10.12.2025 and requested the counsel for the forest department to file its counter affidavit, as the subject matter pertains to forest department. A counter affidavit is filed and is served on the other side.
5. It is submitted by learned counsel for petitioners that petitioner No.1 is in enjoyment and possession of land to an extent of Acs.2.00 guntas, out of total extent of Acs.9.00 guntas, in Sy.No.17/1/E2, situated at Laxmidevipally Village, Kothagudem Mandal, Khammam District.
