This writ petition is filed to declare the orders of the Revenue Divisional Officer in appeal No.D/1690/2009, dated 29.06.2013 and also the Orders of the Joint Collector passed in Revision Petition No.D1/3597/2013, dated 25.03.2019, ordering for correction of entries in the revenue records from the year 1962-63 onwards to till date with reference to the land in survey No.726 of Bommakal Village and Mandal, Karimnagar District as illegal, arbitrary and contrary to provisions of the T.S.Rights in Land and Pattadar Passbook Act, 1971 (for short ‘the Act, 1971’) and rules made thereunder and for consequential relief.
2. Heard Sri Praneeth, learned Counsel representing Sri Lakshma Reddy, learned Counsel for petitioners on record, learned Assistant Government Pleader for Revenue and Ms.M.Rajeshwari, learned Counsel for respondent Nos.6 & 7.

Brief facts of the case as averred in the writ affidavit are that originally, one Mohd.Shah Khan, was the absolute owner and possessor of land admeasuring Acs.5-20 gts in Sy.No.726 of Bommakal Village, Karimnagar Mandal & District (hereinafter referred to as ‘subject property’) and his name was recorded in Khasra Pahani for the year 1954-55 and continued in the revenue records till 1965 to 1968; that he sold an extent of Acs.2-10 gts to one Sadaveni Lachaiah, under registered sale deed Nos.1327 of 1965, dated 06.07.1965 and 1373 of 1966, dated 22.06.1966, an extent of Ac.1-00 gts to Kachakayala Narsaiah, under registered sale deed No.1325 of 1965, dated 15.07.1965 and an extent of Acs.2-26 gts to Goski Bhoomaiah, under unregistered sale deed and the same was validated by Tahsildar, Karimnagar, vide proceedings No.5372 of 1968, under Section 50(B) of A.P.(Telangana Area) Tenancy Act, 1950 (the Act, 1950’); that the Tahsildar, Karimnagar, incorporated the names of Sadaveni Lachaiah, Kachakayala Narsaiah and Goski Bhoomaiah, in the revenue records and issued pattdar passbooks in their favour.

It is further averred that in the year 1985, an extent of Ac.0-26 gts in Sy.No.726, was acquired for formation of Rajiv Gandhi Rahadari Road, Karimnagar, and compensation was paid to Goski Bhoomaiah and Kachakayala Narsaiah. While so, respondent No.6 filed an appeal before respondent No.4/RDO in the year 2009 i.e., after 47 years, seeking to rectify the entries in the revenue records from the year 1962-63, claiming that he has inherited the land from his father i.e., Anwar Shah Khan; that petitioners entered appearance and filed a detailed counter, however, the respondent No.4 without giving any reason, allowed the appeal vide Order dated 29.06.2013. Aggrieved by the same, petitioners preferred a revision before respondent No.3/Joint Collector; that the Joint Collector vide Order dated 25.03.2019, dismissing the revision confirming the Orders of R.D.O. Aggrieved by the same, present writ petition is filed.

Learned Counsel for the petitioners would submit that the appeal filed by respondent No.6 before RDO itself is not maintainable, since the same is filed after long lapse of time and further, no application has been filed to condone the delay in preferring the appeal; that the names of purchasers from the original owner have been mutated in the revenue records and are in possession of their respective lands for the last 43 years; that father of respondent No.6 had filed a suit vide O.S.No.20 of 1975, for partition and in the said suit, father of respondent No.6 had not claimed any partition of subject land in Sy.No.726 and even, the said suit was dismissed on the ground that there was already a partition among the family members of Anwar Shah Khan i.e., father of respondent No.6 and the appeal filed by him was also dismissed.
6. Learned Counsel for petitioners further submitted that apart from confirming the Orders of R.D.O, the revisional authority exceeded its power and jurisdiction and held that sale transactions and mutations are not done in accordance with law and that the subject property
