O R D E R:

This Contempt Case is filed alleging wilful disobedience of the order dated 11.08.2025 in Writ Petition No. 23632 of 2025.

The case of petitioner is that she filed the Writ Petition seeking a direction to Respondents 2 and 3 therein to implement the order dated 06.12.2016 in LTR Case No. 6/2016/MKP of the Agency Divisional Officer, Kothagudem, by restoring possession of land in Survey No. 116/30, admeasuring Acs. 3.08 gts situated at Rachannagudem Village, in his favour. It is contended therein that respondents failed to implement the order passed under the Andhra Pradesh Scheduled Areas Land Transfer Regulation, 1959 as extended to Telangana Scheduled Areas Land Transfer Regulation Act 1 of 1970.

This Court, while disposing of the said Writ Petition, on 11.08.2025, observed that no Appeal had been preferred against the order dated 06.12.2016 passed in LTR Case No. 6/2016/MKP before the Appellate Authority and that the said order had not been implemented. Accordingly, this Court directed Respondents 2 and 3 to consider the representation dated 17.07.2025 submitted by petitioner and pass appropriate orders thereon, following the principles of natural justice, within four weeks from the date of receipt of a copy of the order.

4. Petitioner alleges that despite service of the order dated 11.08.2025 along with fresh representation and supporting documents, respondents failed to implement the order in its true spirit. According to petitioner, only a xerox copy of panchanama was furnished on 04.11.2025 and actual physical possession was never restored. It is further alleged that Pattadar Pass Books were also not issued in his favour. It is further alleged, the 3rd respondent, who is a non-tribal, continues to remain in possession of the subject land and is allegedly influencing Respondents 1 and 2. It is the specific contention of the petitioner that the order dated 06.12.2016 passed in LTR Case No. 6/2016/MKP conclusively established her title and, therefore, no further title documents could have been insisted upon by the respondents for issuance of Pattadar Pass Books.

It is stated, the said land was allegedly grabbed by the 3rd respondent, a non-tribal, against which petitioner filed LTR Case No. 6/2016/Mkp before the Agency Divisional Officer, Kothagudem, and the said LTR Case was allowed on 06.12.2016 after hearing arguments. Despite several representations and applications made by petitioner to Respondents 1 and 2 after the said order, no effective action was taken for restoration of possession.

Respondent No.1 filed counter stating that the 2nd respondent issued Memo vide Rc.No. B/444/2025, dated 09.08.2025, directing the Mandal Surveyor and Girdawar-II, Mulkalapally, to implement the order passed in LTR Case No. 6/2016/MKP and submit a panchanama report, failing which the scheduled land would be taken into Government custody for further purpose. Pursuant thereto, panchnama was conducted on 20.09.2025 by the Mandal Surveyor and Girdawar-II and their report was submitted to the 2nd respondent.

6.1. It is stated, on 02.11.2025, learned counsel for petitioner submitted a representation seeking implementation of the order dated 11.08.2025. Accordingly, the 2nd respondent complied with the order and issued proceedings vide Lr.Rc.No. B/444/2025, dated 13.11.2025, after conducting survey and handing over possession to petitioner under the cover of panchanama, which was acknowledged by petitioner. The said proceedings were also communicated to the District Collector, Bhadrachalam and the RDO, Kothagudem.

6.2. It is further stated, delivery of possession does not automatically entitle petitioner for issuance of Pattadar Pass Book and under the relevant revenue laws and procedure, issuance of Pattadar Pass Book requires establishment of valid title over the subject land. Accordingly, the 2nd respondent issued Memo vide Rc.No. B/444/2025, dated 14.11.2025, directing petitioner to produce valid title documents such
