IN THE HIGH COURT FOR THE STATE OF TELANGANA AT HYDERABAD
E.V. Venugopal, J
Refresh Hub and Beauty Spa – Appellant
Versus
State of Telangana – Respondent
WRIT PETITION No.17380 of 2026
For the Appellants/Petitioners: Tallari Raju, Revelli Ramanjaneyulu
For the Respondents: M. Srinivas
Right to carry on business (Art. 19(1)(g)) is permitted for spa centres subject to obtaining statutory permissions and adhering to court-mandated guidelines to prevent immoral activities, including maintaining visitor registers and ensuring transparency.
Headnote:The petitioner, a beauty and wellness spa provider, challenged the interference of police officials in its lawful business under notification No. (L&O)/M4/3140/2010, alleging violations of Articles 14 and 19(1)(g) of the Constitution of India. The petitioner contended that it was already complying with the guidelines laid down by the Court in W.P.No.16281 of 2010 regarding the maintenance of customer records and transparency during working hours to prevent immoral activities. The primary issue was whether the petitioner could continue its business operations without a specific court order, provided it adhered to existing judicial directives and statutory requirements. The court observed that the respondents agreed to follow the directions issued in W.P.No.16281 of 2010, which balance the right to carry on business with the state's interest in preventing illegal activities. This Writ Petition is disposed of directing the petitioner to obtain necessary mandatory permissions from the statutory authority to run the spa business in addition to follow the directions issued by this Court in the order dated 28.09.2021 in W.P.No.16281 of 2010 and batch.
