IN THE HIGH COURT FOR THE STATE OF TELANGANA AT HYDERABAD
E.V. Venugopal, J
Tens Spa and Salon – Appellant
Versus
State of Telangana – Respondent
WRIT PETITION No.17627 of 2026

Beauty and wellness centers/massage parlors may operate subject to strict guidelines, including maintaining detailed customer registers and ensuring transparency of premises to prevent immoral activities, provided all statutory permissions are obtained.

Headnote:The petitioner, a beauty and wellness business, challenged a notification issued by the Commissioner of Police as illegal and discriminatory, alleging it violated Article 14 and 19(1)(g) of the Constitution of India and the Hyderabad City Police Act, 1348 Fasli. The petitioner sought a Writ of Mandamus to set aside the notification due to frequent police interference without due process. The court examined whether the petitioner's business operations could be permitted based on existing judicial guidelines. The court referred to a previous batch of similar petitions (W.P.No.16281 of 2010) where it had formulated guidelines requiring massage centers to maintain customer registers (names, addresses, and phone numbers), keep main doors open during working hours, and allow verification by officers not below the rank of Sub-Inspector to ensure no immoral activities occur. The petition is disposed of in terms of the Common Order dated 28.09.2021 in W.P.No.16281 of 2010 and batch, directing the petitioner to obtain all mandatory statutory permissions.
