IN THE HIGH COURT FOR THE STATE OF TELANGANA AT HYDERABAD
T. Madhavi Devi, J
R.K. Beaty and Spa – Appellant
Versus
State of Telangana – Respondent
WRIT PETITION No. 19970 OF 2026

Lawful business activities of spa centers are protected from state interference provided the operators strictly adhere to the court-mandated guidelines established to prevent illegal activities.

Headnote:The petitioner challenged a notification issued by the 2nd respondent under the Hyderabad City Police Act, 1348 Fasli, alleging that it was illegal, arbitrary, and violative of Article 14 and 19(1)(g) of the Constitution of India. The petitioner, who operates a spa business, contended that the respondent-police were using the notification to threaten their business operations. The primary issue was whether the notification dated 30.06.2010 should be set aside and whether the respondent-authorities could interfere with the petitioner's business. The court observed that guidelines governing spa centres had already been established in W.P.No.16281 of 2010 and batch, and as long as these guidelines are followed, there is no ground for police interference. In view thereof, this Writ Petition is disposed of with a direction to the petitioner to strictly follow the guidelines issued by this court in W.P.No.16281 of 2010 and batch.
