ORDER
This Writ Petition is filed seeking the following relief:
“…to issue a Writ of Mandamus or any other appropriate Writ, order or direction Declaring the action of the Respondents in arraying the Petitioner as Accused No. 4 in Crime No. 1623 of 2025 of Cyber Crime Police Station, Rachakonda, LB Nagar, Hyderabad as illegal, arbitrary and violative of Articles 14, 19 and 21 of the Constitution of India Directing the Respondents to delete the name of the Petitioner from the array of accused in Crime No. 1623 of 2025 of Cyber Crime Police Station, Rachakonda, LB Nagar, Hyderabad and to treat him as a Victim / Witness Directing the Investigating Officer (Respondent No. 7) to record the statement of the Petitioner as a witness and utilize his information for tracing the absconding accused A3 - Samarth and other accused persons Directing the Respondents not to file the Final Report / Charge Sheet against the Petitioner treating him as an accused pass…”
2. Heard learned counsel for the petitioner and learned Assistant Government Pleader for Home, appearing for respondents No.1 to 7.
3. Learned counsel for the petitioner submitted that the petitioner had submitted a detailed representation dated 10.07.2026 addressed to respondent No.1 with the copies marked to other respondents and he is seeking a direction to the respondent police to consider the same before filing of the charge sheet.
4. Learned Assistant Government Pleader for Home submitted that respondent No.3 is the competent authority to consider the representation of the petitioner.
5. In view of the above submissions and since respondent No.3 is the competent authority to take a decision on the representation of the petitioner dated 10.07.2026, respondent No.3 is directed to consider the said representation and take a decision thereon, in accordance with law, before filing the charge sheet in the Crime No.1623 of 2025.
6. With the above directions, this Writ Petition is disposed of. There shall be no order as to costs. Miscellaneous applications, if any, pending shall stand closed.
