Heard Mr. S. Venkateswarlu, learned counsel for the petitioner, and Mr. N. Bhujanga Rao, learned Deputy Solicitor General of India for the State of Telangana, appearing for the respondents.

Learned counsel for the petitioner submitted that the petitioner is Accused No.1 in C.C.No.518 of 2023 pending trial in the Court of XV Additional Metropolitan Magistrate, Kukatpally, Cyberabad (‘trial Court’), wherein the petitioner is charged for the offence under Section 498-A IPC and Sections 3 and 4 of the Dowry Prohibition Act. It is submitted that even prior to registration of Crime in the said case, the petitioner had been staying in Paris. The petitioner, in fact, travelled several times to India and there is no order passed by the trial Court restricting his movements. The passport of the petitioner expired on 26.06.2026. The petitioner submitted application vide reference No.25- 2056380727 for renewal of passport. Due to pendency of criminal case, the application is not being considered.

3. Learned Deputy Solicitor General of India appearing for the respondents submitted that as per the judgment dated 17.02.2026 in W.A. No.194 of 2026 and the judgment dated 05.02.2026 in W.A. No.128 of 2026, the petitioner has to approach the trial Court by filing an appropriate application in C.C.No.518 of 2023 for grant of No Objection Certificate (NOC) for renewal of the passport and/or for travelling abroad. As and when such permission is granted, the petitioner is at liberty to approach respondent No.2 for issuance of fresh passport/renewal of his passport.

4. In the light of the above submissions, taking note of the judgment dated 17.02.2026 in W.A. No.194 of 2026 and the judgment dated 05.02.2026 in W.A. No.128 of 2026, the writ petition is disposed of, directing the petitioner to submit appropriate application in C.C.No.518 of 2023 before the trial Court seeking No Objection Certificate for renewal of the passport and/or for travelling abroad. Upon such application being filed, the trial Court shall dispose of the same within a period of one (01) week thereafter, by issuing notice to the petitioner, the concerned Public Prosecutor and the de facto complainant and also by affording an opportunity of hearing to them.

There shall be no order as to costs.

As a sequel thereto, miscellaneous applications, if any, pending in this writ petition stand closed.
