This writ petition is filed by the petitioners under Article 226 of the Constitution of India seeking the following relief: “… to issue such appropriate writ, order or direction more so particularly one in the nature of certiorari by setting aside the order passed by the respondent No.2 in Tribunal Case No. 273 of 2021 (ROR Appeal Petition No. E/656/2016/RDO) dated 25.06.2021 by declaring the same as arbitrary, illegal, without jurisdiction and against the statutory provisions and pass such other order as this Hon’ble Court may deem just in the circumstances of the case…”

FACTS IN BRIEF

3. The dispute in the present writ petition concerns agricultural land admeasuring Ac.3.00 in Sy.No.727/1 situated at Chinnagudur Village and Mandal, Mahabubabad District (hereinafter referred to as “the subject land”). An extent of Ac.1.00 in Sy.No.727/1/A out of the said land forms the immediate subject matter of the rival claim.

4. According to the petitioners, the subject land originally belonged to one Murari Somaiah and, upon his demise, devolved upon his son, Murari Chandraiah, whose name was duly mutated in the revenue records and to whom a pattadar pass book was issued. After the death of Murari Chandraiah on 28.05.2017 the property was mutated in the name of petitioner No.1, his widow, by way of succession.
