Heard Mr. P. Majumder, learned counsel along with Ms. V. Poddar,

learned counsel appearing for the applicants. Also heard Mr. R. Datta,

learned P.P. assisted by Mr. S. Debnath, learned Addl. P.P. appearing for the

State-respondent.

These bail applications have been filed under Section 439 of Cr.P.C.

for granting bail to the accused-applicants, namely, Purnendu Ghosh, Md.

Alkam Ali, Md. Jahir Uddin, Sri Dipankar Sinha, Sri Sujan Sen and Sri

Biswanath Sinha who have been in custody since 12.09.2023 after being

arrested in connection with Kailashahar P.S. Case No.117/2023, under

Sections 120(B)/468/471/409 of IPC and Section 13(A) of PC Act.

All these bail applications are taken up together for hearing and

disposal by this common order on consent of learned counsel appearing for

the parties.

Learned P.P. has produced the case diary before this Court.

It is revealed from the audit report that as directed by the authority

concerned, the applicants have deposited the entire money alleged to be

defalcated by the applicants.

Learned counsel appearing for all the applicants submit that they may

be enlarged on bail since investigation has almost completed.

The case is based upon documents and all the documents have been

taken in custody of the investigating officer.

In the light of above, I am inclined to release the applicants on bail in

connection with the aforementioned Kailashahar P.S. Case No.117/2023.

Accordingly, the applicants , namely, Purnendu Ghosh, Md. Alkam

Ali, Md. Jahir Uddin, Sri Dipankar Sinha, Sri Sujan Sen and Sri Biswanath

Sinha shall furnish a bail bond of Rs.1,00,000/- (Rupees one lakh) each with

one surety of like amount each, to the satisfaction of the learned special

Judge, Unakoti District, Kailashahar.

It is directed that the applicants shall not try to tamper the evidence

and also shall not make any attempt to influence any witness of the

prosecution.

In terms of above, the bail applications are accordingly allowed and

disposed of.
