Heard Mr. P. Roy Barman, learned senior counsel appearing for

the petitioners as well as Mr. D. Bhattacharya, learned G.A. appearing for the

respondents.

The case of the petitioner is that the petitioners in this instant

petition are all permit holders under the Motor Vehicles Act issued by the

competent authority to run their vehicles in a particular road i.e. from

Radhanagar Motorstand to Kalkalia via Bamutia route, Radhanagar

Motorstand to Taltala via Bamutia route and Radhanagar Motorstand to

Bamutia via Gadhigram. According to the petitioner, in para-5 of this instant

petition the other auto-rickshaws were given permits by the Transport

Department to ply vehicles on the Bamutia to Shalbagan via Nashingar rout,

Narshingar to Lambuchara via Durgabari route and Kalibazar to Mohanpur

route.
