The present Application has been filed by the applicant seeking anticipatory bail in Case Crime No.68 of 2025, registered at Police Station Kunda, District Udham Singh Nagar under Sections 109 , 324(2), 3(5), 61(2) of the Bharatiya Nyaya Sanhita, 2023 and Section 25 (1-B) (a) of the Arms Act, 1959 .
2. As per the First Information Report dated 23.03.2025, on 22.03.2025 at about 5:00 p.m., persons sitting in a car (Scorpio, Registration No.UP37P4751) opened fire on the car (Registration No.UK08TA7686) of the informant. One person was identified whose name is Salman.
3. Heard Mr. D.N. Sharma, learned counsel for applicant, Mr. Pradeep Lohani, learned Brief Holder for respondent and Mr. M.C. Kandpal, learned Senior Advocate assisted by Mr. Devesh Kandpal, learned counsel for informant.
4. Mr. Pradeep Lohani, learned Brief Holder, Advocate and Mr. M.C. Kandpal, learned Senior Advocate, on instructions, have sought three weeks’ time to file objection to the Anticipatory Bail Application.
5. Time is granted.
6. Mr. D.N. Sharma, Advocate, contended that the applicant has been falsely implicated in the present matter. He was not present on the spot. He is a permanent resident of District Hapur (Uttar Pradesh), therefore, there is no likelihood of his absconding, and, he is not a convicted person.
7. Having heard the submissions of learned counsel for the parties and in the facts and circumstances of the case, as an ad-interim measure, it is directed that in the event of arrest of the applicant Shahinoor Chaudhary, he shall be released on interim bail on executing a personal bond of Rs.30,000/- and two reliable sureties, each of the like amount, to the satisfaction of the Investigating Officer/
Arresting Officer, subject to the following conditions:-
(i) Applicant shall cooperate with the Investigating Agency and he shall make himself available for interrogation by a police officer as and when required;
(ii) Applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of this case.
(iii) Applicant shall not leave the country without the previous permission of this Court.
8. List on 28.07.2025 for hearing on the Anticipatory Bail Application.
