Bora, learned Deput y Advocat e General for t he St at e of Ut t arakhand. Pet it ioners have sought quashing of 2. F.I .R. No. 52 of 2021, regist ered against t hem for offence punishable under Sect ions 409 & 420 I .P.C. in Police St at ion Pat hri, Dist rict Haridwar. Learned St at e Counsel subm it t hat , . upon invest igat ion, charge sheet has been filed against t he pet it ioners on 25.12.2021. Thus, it is cont ended t hat writ pet it ion has becom e infruct uous. The said cont ent ion, however, cannot be accept ed. Mere filing of charge sheet will not render t he writ pet it ion infruct uous. Hon’ble Suprem e Court in t he case . of M/ s Neeharika I nfrast ruct ure Pvt . Lt d. Vs. St at e of Maharasht ra & ot hers, report ed in AI R 2021 SC 1918, have laid down param et ers for exercise of power under Art icle 226 of Const it ut ion, in such m at t ers. . The im pugned F.I .R. is on record as Annexure No.1 t o t he writ pet it ion. Perusal of t he F .I .R. reveals t hat ingredient s of offences levelled against t he pet it ioners are m ade out . . Whet her t he allegat ions are t rue or unt rue, would have t o be decided in t he
7 8 t rial. While exercising power under Art icle 226 of t he Const it ut ion, t his Court is not expect ed t o em bark upon an enquiry int o, whet her t here is reliable evidence or not . I t is not a case where FI R does not , disclose any offence. None of t he param et ers laid down by Hon’ble Suprem e Court , for invoking power under Art icle 226 of t he Const it ut ion for quashing an FI R, are m et in t he present case. . I n such view of t he m at t er, t here is no scope for int erference wit h t he im pugned FI R while exercising ext raordinary power under Art icle 226 of t he Const it ut ion. Accordingly, t he writ pet it ion fails . and is dism issed.
