Pet it ioner filed a Money Recovery Suit against respondent no. 1, w hich was decreed. The j udgm ent and decr ee passed in favour of pet it ioner at t ained finalit y. Pet it ioner has put t he decree in execut ion. 4. Before t he Execut ing Court , respondent no. 2 filed obj ect ion st at ing t hat t he propert y from w hich t he Money Decr ee passed is sought t o be sat isfied, was m ort gaged in his favour and t hat propert y has been sold out in a public auct ion t o a t hird part y. 5. I n view of t he st and t ak en by respondent no. 2, learned Execut ing Court passed order dat ed 13.05.2022 asking t he pet it ioner t o supply det ails of som e ot her propert y belonging t o r espondent no.1 from which t he m oney could be recov ered. The said order has been challenged by pet it ioner in t his writ pet it ion. 6. This Court does not find any infirm it y in t he im pugned order . Pet it ioner does not
disput e t he fact t hat respondent no. 2 was having first char ge over t he propert y in quest ion, w hich w as sold out by r espondent no. 2 for recov ery of out st anding dues. Thus, t he order passed by Ex ecut ing Court cannot be fault ed. There is no scope for int erference in t he m at t er. 7. The writ pet it ion is, accordingly, disposed of wit h libert y t o pet it ioner t o m ove appropriat e applicat ion before t he Execut ing Court .
