2. Mr. Pradeep Hairiya, learned Standing Counsel for the State.

3. Mr. I.D. Paliwal, learned Standing Counsel for the State of U.P.

4. Learned counsel for the petitioner place before this court the Government Order dated 22.09.2004 issued by the State of U.P., whereby, the benefit of the family pension was also extended to the dependants of those deceased employees who were died prior to 01.01.1989. The petitioner’s husband died on 02.09.1987 that too prior to the creation of the State, therefore the petitioner is covered by clause-2 of the Government Order dated 22.09.2004. Furthermore, since the deceased employee died prior to the creation of the State, therefore, the liability is vest upon the State of U.P. to pay the family pension to the petitioner.

5. In such view of the matter, learned Standing Counsel for the State of U.P. Mr. I.D. Paliwal is directed to get the positive instructions with regard to the grant of family pension to the petitione
