Mr. Priyanshu Gairola, learned counsel for the Petitioner.
2. Mr. S.S. Chauhan, learned Deputy Advocate assisted by Mr. Vikash Uniyal, learned counsel for the State of Uttarakhand.
3. The present Writ Petition under Article 226 of the Constitution of India has been filed with the following prayer:-
“(i) Issue a writ, order or direction in the nature of Certiorari for quashing the impugned First Information Report dated 03.08.2025 registered as FIR No. 0133 of 2025 under Sections 120B, 406, 420, 506 IPC, Police Station Vasant Vihar, Dehradun.
(ii) Issue a writ, order or direction in the nature of mandamus commanding the respondents not to arrest or take any coercive action against the Petitioners in relation with First Information Report dated 03.08.2025 registered as FIR No. 0133 of 2025 under Sections 120B, 406, 420, 506 IPC, registered at P.S.
Vasant Vihar, Dehradun.”
4. The Petitioner has also filed an Interim Relief Application, being I.A. No. 01 of 2025, seeking a stay on the operation of FIR No. 0133 of 2025, registered under Sections 120-B, 406, 420, and 506 of the Indian Penal Code, 1860, at Police Station Vasant Vihar, Dehradun.
5. Admit.
6. Issue notice to Respondent No. 4.
7. Steps to be taken within a week.
8. Let the objections be filed by the Respondents.
9. Considering the facts and circumstances of the case, as an interim measure, it is directed that till the next date of listing, no coercive action shall be taken against the Petitioner in connection with the FIR No. 0133 of 2025, registered under Sections 120-B, 406, 420, and 506 of the Indian Penal Code, 1860, at Police Station Vasant Vihar, Dehradun, subject to the Petitioner extending full cooperation in the proceedings before the Investigating Agency/Court below. It is further clarified that in the event of non-cooperation by the Petitioner, the interim protection granted herein shall stand automatically vacated.
10. The Interim Relief Application stands disposed of accordingly.
